JFK ASSASSINATION ARGUMENTS
(PART 1295)

CORY SANTOS SAID:

Do you agree or disagree that DCM [Dark Complected Man] sits down on the curb, puts a radio up to his face and turns towards the grassy knoll.

DAVID VON PEIN SAID:

I can't fully agree with that statement re: DCM, because we don't know for a fact that DCM was carrying any "radio" with him at all. You're just guessing. (CTers do a lot of that, I've noticed.)

CORY SANTOS SAID:

You agree DCM sits on the curb?

DAVID VON PEIN SAID:

Yes.

CORY SANTOS SAID:

You agree DCM looks towards the grassy knoll?

DAVID VON PEIN SAID:

Yes. But, so what? A lot of people were looking (and running) toward the Grassy Knoll at that time. DCM was merely watching the various people run up the slope.

You actually think that because DCM merely LOOKED toward the Grassy Knoll, that fact signifies something "conspiratorial" on his part? If so, you're really desperate to grasp any straw you can find, aren't you?

CORY SANTOS SAID:

Do you agree he has something up to his face?

DAVID VON PEIN SAID:

Not necessarily. The thing you think he's got up to his mouth might just be part of the person standing to his right-rear. I can't tell. The picture's not clear enough. (See the photo montage below.) But I doubt that he's holding anything at all. He certainly has nothing in his right hand in the clearer picture just to the right of the fuzzier one. And those photos seem to have been taken at almost an identical point in time. Take note of the position of DCM's left hand and arm in both images. The position of that arm looks exactly the same to me.

CORY SANTOS SAID:

Do you agree this thing appears to have an antenna?

DAVID VON PEIN SAID:

Very hard to tell. The thing you think is an antenna could easily be something else or a photo anomaly. I can see the same type of "straight white line" formed on the back of the uniform of the motorcycle cop in the very same image. What do you think caused that white line? It's certainly not an antenna on the policeman's back.

But let me ask you this:

Are you really suggesting that Mr. Dark Complected Man was part of some assassination plot, and he just casually and calmly decided to get on his walkie-talkie and radio in a message of some kind to his co-plotters within seconds of the shooting --- right out in the open where he knew he was being photographed and filmed?

Talk about some large-sized gonads! Mr. DCM sure had those, didn't he?

Bottom Line:

All the suspicions about "DCM" and "Umbrella Man" and "Black Dog Man" and (a newer one) "Tan Jacket Man" are nothing more than that --- unsupportable "suspicions" by conspiracy believers who are looking for conspirators behind every bush and retaining wall and oak tree in Dealey Plaza—and even right out in the open on Elm Street with open umbrellas and walkie-talkies while being filmed performing their conspiratorial work. It's just plain (dare I say it again?)——silly.

MATTHEW KOCH SAID THIS.

DAVID VON PEIN SAID:

The answer to your question ("Why don't you believe that the bullet in Parkland is from Kennedy's back wound?") is:

It would be impossible for the stretcher bullet (CE399) to have come from JFK's back wound because neither President Kennedy nor his stretcher was ever located in the area of Parkland Hospital where the bullet was found on November 22.

And regarding the large bullet fragments found in the limousine possibly being from a separate bullet that hit Governor Connally's wrist....

Some doctors have stated that Connally's wrist would have sustained more damage if that wrist had been struck by a separate bullet that had not gone through the neck of John Kennedy first.

Although I'm sure that conspiracists won't have any trouble finding some medical professionals of their own that will say something to the contrary. Because as everybody here knows, there are plenty of opinions to go around in this case.

BOB NESS SAID THIS.

DAVID VON PEIN SAID:

I'm not aware of any THIRD attempt by Dr. Humes at writing the final autopsy report. I only know of two such efforts by Humes, which was due to the fact that the first draft of the autopsy report contained some errors or mistakes, which an irritated Dr. Humes attempted to clarify (at least in part) during his ARRB testimony session in February of 1996:

DR. JAMES J. HUMES -- "Well, it [the first draft of the autopsy report] may have had errors in spelling or I don't know what was the matter with it, or whether I even ever did that. I don't know. I can't recall. I absolutely can't recall, and I apologize for that. But that's the way the cookie crumbles. I didn't want anything to remain that some squirrel would grab on and make whatever use that they might. Now, whether you felt that was reasonable or not, I don't know. But it doesn't make any difference because that was my decision and mine alone. Nobody else's."

------------------------

And as for any "confirmation" of the autopsy doctors physically searching for bullets inside President Kennedy's body, we have that confirmation in Dr. Humes' Warren Commission testimony (at 2 H 364):

DR. HUMES -- "Before the arrival of Colonel Finck, we had made X-rays of the head, neck and torso of the President, and the upper portions of his major extremities, or both his upper and lower extremities. At Colonel Finck's suggestion, we then completed the X-ray examination by X-raying the President's body in toto, and those X-rays are available."

ARLEN SPECTER -- "What did those X-rays disclose with respect to the possible presence of a missile in the President's body?"

DR. HUMES -- "They showed no evidence of a missile in the President's body at any point. And these were examined by ourselves and by the radiologist, who assisted us in this endeavor."

BOB NESS SAID THIS.

DAVID VON PEIN SAID:

Yes, Dr. Humes did burn his original autopsy notes in his home fireplace on 11/24/63. And the reason why he burned those notes is a very logical and sensible reason, as Dr. Humes himself explained in his HSCA testimony on September 7, 1978 (at 1 HSCA 330):

DR. HUMES -- "The original notes which were stained with the blood of our late President, I felt, were inappropriate to retain to turn in to anyone in that condition. I felt that people with some peculiar ideas about the value of that type of material, they might fall into their hands. I sat down and word for word copied what I had on fresh paper."

MR. CORNWELL -- "And then destroyed them?"

DR. HUMES -- "Destroyed the ones that were stained with the President's blood."

------------------------

Related discussion from September 2010:

JAMES DiEUGENIO SAID -- "Autopsy report number one: Burned by Humes and testified to by him before the ARRB. He said it three times and it's in the transcript."

DAVID VON PEIN SAID -- "Dr. Humes admitted to the Warren Commission in 1964 that he burned the first draft of the autopsy report [2 H 373]. So we certainly didn't have to wait until Humes' 1996 ARRB testimony to learn about that particular burning episode. And the very fact that Dr. Humes admitted to burning a draft of the autopsy report is a very good sign that that burning was not done with CONSPIRATORIAL intent or with the thought of a COVER-UP in Dr. Humes' mind. For Pete sake, if Humes had been part of a cover-up and/or conspiracy, the last thing in the world he would have ADMITTED to the Warren Commission is that he was burning autopsy papers in his home fireplace. Get real, Jim."

CORY SANTOS SAID THIS.

DAVID VON PEIN SAID:

Since you [Cory Santos] think Marilyn Monroe was murdered, I suppose you believe Dorothy Kilgallen was murdered too, right?

CORY SANTOS SAID THIS.

DAVID VON PEIN SAID:

But when it comes to the topic of Marilyn Monroe's death, you think you've got enough "evidence" to boldly make this claim:

"Arguing Marilyn was murdered, and she was..." -- C. Santos

You, Mr. Santos, have said nothing in either of your previous two posts in this thread that comes even close to being "evidence" to show that Marilyn Monroe was murdered.

CORY SANTOS SAID THIS.

DAVID VON PEIN SAID:

WTF?! You're obviously just playing around now. Because nobody (especially an individual named Cory A. Santos, Sr., Esq.) could possibly think the death of Marilyn Monroe and the gunshot death of Robert Francis Kennedy are equal in the "evidence of murder" department.

You seriously want to know what "evidence" exists to show that RFK was "murdered"?

Is such a silly discussion really warranted?

DAVID VON PEIN ALSO SAID:

FYI / FWIW....

Here are a couple of newspaper front pages following Marilyn Monroe's death in early August of 1962....

DAVID VON PEIN SAID:

From an October 2022 Facebook discussion concerning Ruth Paine:

JOE ALESI SAID:

I saw Ruth yesterday [October 9, 2022] and informed her of the good work you [DVP] are doing to knock down the lies and misinformation people like DiEugenio are spreading. The best part: She doesn’t even know who DiEugenio is.

JOE ALESI LATER SAID:

Max Good has learned that Ruth has now seen “The Assassination and Mrs. Paine”, and [Max] made a post on [The Education Forum]. I’m pleased to announce that not only have I been appointed as Ruth Paine’s Ambassador to the JFK community but could also be her “handler”.

Ruth Paine, handler of Oswald, now has her own handler! I read this to Ruth yesterday and she burst out laughing.

DAVID VON PEIN SAID:

Thank you, Joe, for telling Ruth Paine about my online posts supporting her.

And I think it's good that Ruth isn't very much aware of who Jim DiEugenio is. She's probably better off not knowing much about him.

If you see Ruth again, please give her my very best and let her know how much I admire and respect her.

And if you want to provide her with a good laugh, show her this image (also seen below). Ruth might also get a kick out of our "Richmond, Indiana" connection (which, in part, is true; I was born in Richmond and was living there when Ruth visited that town in September of 1963):

ALLEN LOWE SAID THIS.

DAVID VON PEIN SAID:

And—as usual—a conspiracy theorist (this time someone named Lowe) is more than happy to drag Mrs. Paine through the mud, despite a complete lack of something called "evidence" to support his ridiculous claim that Ruth Paine was an "intelligence operative". And yet this despicable evidence-free hobby of character assassination against Ruth Paine continues—year after year. Pathetic.

MATT ALLISON SAID THIS.

DAVID VON PEIN SAID:

Dorothy Garner only "puts a giant dent in the WC version of LHO going from the 6th floor to the lunchroom" if a person wants to believe that Dorothy had her eyes fixed on the TSBD staircase every single second just after the assassination.

From a 2014 discussion:

"Why in the world would anyone think Dorothy Garner had her eyes transfixed on the STAIRS every single second immediately following the President's assassination? How silly would that be, considering what had just happened outside those fourth-floor, SOUTH-SIDE windows just moments earlier? Why would she (or anyone) have kept a vigil on the staircase? Therefore, since it makes no logical sense to think that Garner (or ANYBODY ELSE) had their eyes peeled on those stairs every second, Oswald could have easily been on that 4th-floor landing for a matter of--what?--five seconds and not been seen by anyone who was on the same floor. Or do conspiracy theorists REALLY want to contend that Dorothy Garner never took her eyes off those stairs between 12:30 and 12:32 PM? That's incredibly silly to believe that's the case (even if she DID catch a glimpse of Truly and Baker)." -- DVP; October 2014

PETE MELLOR SAID THIS.

DAVID VON PEIN SAID:

I never once questioned Garner's eyesight. I'm questioning the idea that Dorothy Garner kept a continuous second-by-second vigil on the back staircase just after the assassination. Such a notion is ridiculous.

Nobody can possibly prove that Dorothy Garner had her eyes on this stairway in the northwest corner of the Book Depository Building (also pictured below) for every moment of that (approx.) 120-second period (or however many minutes and seconds it actually was).

Also --- Take a look at the small area of the 4th floor that we're talking about here (i.e., the stairwell area in the upper-left corner of the floor plan I've presented below). How much time do you think it would have taken Lee Oswald (or anyone) to have navigated that corner stairway as he quickly came down from the fifth floor?

In other words, how long would Oswald have been in view of anyone on the 4th floor who happened to be looking toward the northwest corner during those few fleeting seconds? I'm guessing five seconds, tops. And after those few seconds on the corner "landing", he then would be totally out of sight of anyone on the fourth floor.

I can easily envision a scenario which has the sixth-floor assassin (namely: a Mr. Oswald) avoiding detection as he swiftly rounds that stairwell corner and flees down those stairs toward the third floor. And, realistically, all he needs in order to do that is five measly seconds away from the gaze of any prying eyes (maybe even less than five seconds).

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

Has Dorothy Garner ever been interviewed by anyone, Pat? (Beyond the very short "Stroud document", that is.) Did she ever give any details about exactly where she was located (in relation to the stairs) at 12:30 to 12:32 PM CST on 11/22/63?

That would certainly be an important detail to know, don't you think?

The Stroud document is indeed interesting. But before declaring Oswald innocent, I think a little more info is needed beyond just this one single sentence regarding Miss Garner in this June 1964 letter:

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

Thanks for that info, Pat. (And thanks to Barry Ernest too.)

Knowing the evidence that exists against Lee Oswald as I do, my opinion is (and has been for many years) that Oswald did use those back stairs to flee from his sixth-floor sniper's perch, and he did somehow manage to walk between the raindrops (so to speak) so as to avoid being seen by anyone on any of the TSBD floors that he had to traverse in order to make it to the second-floor lunchroom by approximately 12:32 PM.

And, IMO, the information supplied by Dorothy Garner does not and cannot exonerate Lee Harvey Oswald for the assassination of the President, given the evidence that exists against him.

And if LHO wasn't the sixth-floor sniper, then the question needs to be asked --- How, then, did the real 6th-floor assassin(s) manage to avoid being seen by Garner, et al, in the minutes following JFK's murder?

That is certainly a legitimate and valid question that has never been satisfactorily answered (IMO) by any conspiracy theorist.

JAMES DiEUGENIO SAID THIS.

DAVID VON PEIN SAID:

Oh sure, Jim. A trial judge would have tossed the case against Oswald in the trash---despite the fact that every scrap of evidence up there on the 6th floor* pointed in the direction of Lee Harvey Oswald being the assassin (e.g., Oswald's rifle, his prints on the boxes in the Sniper's Nest, the CE142 paper bag with Oswald's prints on it, and the shell casings from LHO's gun).

And yet Jim D. keeps assuring everyone that it's me (and not the conspiracy theorists) who resides in a world of fantasy.

* Evidence which you, Jim, think is all fake, of course. But that's another fifty arguments/threads.

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

The question would then become: How did these two guys---dressed like cops!---get into the building and up to the sixth floor prior to the assassination without a single person noticing either one of these "cops"?

And remember: the sixth floor was well-populated that day, with extra workers up there laying the new floor (up until about 11:45 AM, that is).

SEAN COLEMAN SAID THIS.

DAVID VON PEIN SAID:

But the same question I asked previously still applies. Especially when considering the repeated "I saw no strangers in the TSBD on Nov. 22" statements that exist within Commission Document No. 706 (aka CE1381):

JEAN PAUL CEULEMANS SAID THIS.

DAVID VON PEIN SAID:

Since you've touched on the subject of Bonnie Ray Williams and the fact that he decided (for whatever reason) to litter the sixth floor of the Book Depository with the remnants of his lunch on 11/22/63....I hope everyone here won't mind if I indulge in a little bit of comic relief on the topic of Bonnie Ray and his Nov. 22nd lunch feast....

My favorite part of Bonnie Ray Williams' Warren Commission session [seen here] has always been his testimony about the chicken-on-the-bone sandwich that he said he ate for lunch when he was up on the 6th floor on 11/22.

I can't help but chuckle whenever I run across that testimony. And so, just for fun, in the year 2010 (in this Usenet newsgroup posting) and again in 2016 (in this post at The Education Forum), I decided to spread the mirth and merriment concerning Bonnie Ray's hard-to-swallow noontime meal in those two Internet messages linked above (and screen-captured below).

P.S. -- If Bonnie Ray Williams is still with us here on this Earth, I want him to know that I'm not making fun of him. I'm only snickering at his choice of November 22 luncheon entrees, which should have made every dentist in Dallas County jump for joy due to the increased business Bonnie Ray's bone-riddled poultry delicacy surely supplied them.

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

Except for the fact that sausage and bacon don't have any bones in them. So your examples are not really fair comparisons to a bone-in chicken "sandwich".

Putting a piece of bone-in chicken between two pieces of bread is ludicrous (in the south or anywhere else). What's the point of even doing that when nobody who isn't insane is going to pick it up and eat it as a "sandwich" anyway? It's just silly.

But, as they say, variety is the spice of life (and sandwiches). :)

BTW, Joseph Ball of the Warren Commission [at 3 H 169] also seemed to think it was a bit strange to eat a sandwich with bones in it.

LARRY HANCOCK SAID THIS.

DAVID VON PEIN SAID:

I love chicken sandwiches. In fact, when I operated my KFC restaurant here in the Hoosier State, I would regularly take one of our center-cut breast pieces (which we referred to as a "keel") and make a sandwich out of it for my lunch. But I'd make sure to debone the bird before putting any of it between the bread. Which is what any sensible person would do, of course. (No offense to the south—or to Mr. Bonnie Ray Williams—intended.) :)

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

Well, of course a "sandwich" consists of bread and meat, Pat. No argument there. The ridiculous thing that we've been talking about in this thread is having BONES in a SANDWICH. Because "Bones" and "Sandwich" do not mix. No way, no how.

DAVID VON PEIN ALSO SAID:

As a side note to all this "chicken" talk, I thought I'd post this newspaper ad that I found recently, which is something that really illustrates in no uncertain terms just how much times have changed since 1963 when it comes to the cost of fast food in North America.

Just take a gander at all the food you could get for only $4.95 at the local KFC outlet in Windsor, Ontario, Canada, in July of 1963! This Picnic Pack seems like a steal of a deal---even for JFK's era. This amount of food would cost over $50 today. Oh, how I wish it were 1963 again! If only to see these prices one more time! ....

More shockingly low food prices from the 1950s and 1960s can be found amongst the various KFC ads I've collected and put on this webpage. It's a time warp experience indeed.

DVP ALSO SAID THIS.

JOSEPH McBRIDE SAID THIS.

DAVID VON PEIN SAID:

Nonsense. The widespread inaccurate reporting on radio and television on November 22nd about Oswald eating a chicken dinner while waiting for JFK to enter the kill zone was just another of the innocent and understandable mistakes made by the media in the immediate aftermath of the assassination. It wasn't designed to be "propaganda" at all.

At the time those erroneous "chicken dinner" reports were being broadcast, the media really did think the President's killer was up there on the 6th floor munching on chicken while he waited for Kennedy to arrive in Dealey Plaza. And given the close proximity of the chicken scraps and the soft drink bottle to the assassin's Sniper's Nest in the Depository, a reasonable and understandable conclusion to reach was that JFK's murderer had, indeed, been the one who was dining on chicken just before pulling the trigger.

No intentional "propaganda" there at all. Merely a perfectly logical mistake made by media personnel who were merely trying their best to quickly report to the world all the details they could concerning one of the worst tragedies of the 20th century. Nothing more than that.

DAVID VON PEIN LATER SAID:

The key to knowing with 100% certainty that the Baker/Oswald encounter occurred on the second floor in the lunchroom is this affidavit filled out on 11/23/63 by Roy S. Truly. Truly, of course, knew Oswald on sight and Truly also knew the layout of the TSBD building by heart.

Truly affidavit excerpt (emphasis added by DVP):

"The officer and I went through the shipping department to the freight elevator. We then started up the stairway. We hit the second floor landing, the officer stuck his head into the lunch room area where there are Coke and candy machines. Lee Oswald was in there. The officer had his gun on Oswald and asked me if he was an employee. I answered yes." -- Roy Truly; 11/23/63

So, in order to believe there was NO "lunchroom encounter" at all (which is the ridiculous theory being proposed by many Internet CTers nowadays), we'd have to believe that Roy Truly just flat-out lied about multiple things relating to that 2nd-floor encounter in his 11/23 statement.

Plus, Marrion Baker would have to be a liar as well....because in later interviews and TV appearances, he also confirmed that the encounter took place on the second floor and in the lunchroom.

Why are so many conspiracists so willing and eager to call both of those men rotten liars?

~shrug~

BILL FITE SAID THIS.

DAVID VON PEIN SAID:

Yes, it would have been ideal if Officer Baker had detained Oswald instead of letting him go. And I'm guessing that Marrion Baker often had feelings of guilt himself for allowing the assassin to escape the building. If Baker had detained Oswald on the spot in the lunchroom, it would, of course, have saved the life of J.D. Tippit.

But, as they say, hindsight is very nearly always 20/20.

BILL FITE SAID THIS.

DAVID VON PEIN SAID:

In a perfect world—with unlimited manpower and resources—yes, I agree with you on this 100%, Bill.

Unfortunately, there is no such world. Never has been.

JOHN IACOLETTI SAID:

Nick McDonald was an attention seeker who fancied himself a hero. In reality he was guilty of egregious police misconduct:

....He searched Oswald and others in the theater without a warrant or probable cause.

....He participated in the arrest of Oswald for murder without a warrant or probable cause.

....He punched a suspect in the face.

....He mishandled evidence.

....He embellished his story every time he retold it.

DAVID VON PEIN SAID:

More crap from Iacoletti, as he pretends McDonald wasn't injured in the fray in the theater. Per Iacoletti, Nick McDonald was guiltier than Lee Oswald. Disgusting disinfo. I'll go vomit now.

ANDREW PRUTSOK SAID THIS.

DAVID VON PEIN SAID:

What you just said is not so "mind-boggling" when you realize that the autopsy photos almost totally contradict all of those Parkland witnesses with respect to the location of JFK's large head wound.

The authenticated-as-genuine autopsy photographs and X-rays simply must trump any and all eyewitnesses....no matter how many witnesses are saying something different.

But, of course, those Parkland witnesses are believed by many, many people—such as yourself, Andrew, plus about 60%-70% of America, which is the approximate current number of people who say they believe a conspiracy existed on November 22, 1963.

RON BULMAN SAID THIS.

DAVID VON PEIN SAID:

But then her very next words were...

"...because the motorcade was coming near us and no one was calling..."

...which implies that when she used the word "dead", she merely meant that there was no phone-call activity at that time. I don't think she meant the phones wouldn't work at all.

When evaluating Geneva Hine's entire statement (which is from her Warren Commission testimony, at 6 H 395), I think Bill Brown has got it correct. Hine was talking only about the lights on the telephones and not about the lights or the electricity in the entire building when she said "the lights all went out"....

"I was alone until the lights all went out and the phones became dead because the motorcade was coming near us and no one was calling so I got up and thought I could see it from the east window in our office." -- Geneva L. Hine

It's remarkable how something like Miss Hine's WC testimony above can get twisted and misinterpreted by conspiracy believers until it mushrooms into something conspiratorial and sinister, when in reality it's not the slightest bit sinister at all.

DAVID VON PEIN ALSO SAID:

We can be pretty sure the phones in the Book Depository did not go "dead" right around the time of the assassination, because we have this additional Warren Commission testimony from Miss Geneva Hine, which is testimony at 6 H 396 which certainly implies that the TSBD telephones were working within a very very short time of when the shooting occurred:

"And there was a girl in there [the office of Southwestern Publishing Co.] talking on the telephone and I could hear her but she didn't answer the door. .... I called and called and shook the door and she didn't answer me because she was talking on the telephone; I could hear her. They have a little curtain up and I could see her form through the curtains. I could see her talking and I knew that's what she was doing."

Plus....

We also know that the telephones inside the Depository were working just a few minutes after the assassination took place, because Robert MacNeil of NBC News used one of the TSBD phones to call the NBC Radio Network and was put on the air live with that network's first bulletin concerning the shooting. MacNeil's initial bulletin can be heard here.

So, if the phones in the Texas School Book Depository went dead right around the time President Kennedy was being shot out on Elm Street, then they certainly didn't remain "dead" for very long at all.

BENJAMIN COLE SAID THIS.

DAVID VON PEIN SAID:

According to Robert MacNeil himself in this November 18, 2000, interview (fast forward to 13:30), the telephone call he made from the Book Depository on 11/22/63 was made from one of the TSBD offices using "one of those old black phones with four clear Lucite buttons":

"I went into an office. There was one of those old black phones with four clear Lucite buttons, and two of them were lit up and two of them weren't, and I dropped one down and I got through to NBC in about ten seconds." -- Robert MacNeil; 11/18/2000

REVISITING SOME POSTS FROM
NINE YEARS AGO...

ON AUGUST 17, 2013, DAVID VON PEIN SAID:

In this forum thread, once again, we're treated to people using their vivid imaginations to stamp a specific identity on a fuzzy and very indistinct human being seen in a low-quality film/photo.

How in the world can anyone positively say WHO "prayer man" is here? It's impossible.

ROBERT PRUDHOMME SAID THIS.

DAVID VON PEIN SAID:

I think a better question might be:

Why would Oswald have a desire to follow a policeman into the building and then race upstairs to buy a Coke at that exact moment in time?

The above question is a particularly valid one (even to most conspiracists), since almost all CTers acknowledge the fact that Oswald was most certainly "involved" in the assassination "plot" in some manner.

In that set of circumstances (with Oswald involved in some plan to kill the President), can anyone imagine LHO wanting to go back inside the building from which shots had just been fired?

Given the make-believe fantasy scenario I just outlined, wouldn't Oswald be much better off just staying outside the building entirely?

In reality, of course, Oswald was inside the building when those Darnell and Wiegman images were taken. Lee Harvey, at that time, was in the process of hiding his rifle between boxes on the sixth floor and then hurrying down the back stairs after having just fired three shots at the President.

MARTIN HINRICHS SAID THIS.

DAVID VON PEIN SAID:

I had never really thought of it from that perspective before, Martin. Not a bad point. But, on the other hand, we must consider other things too -- the fact that [Malcolm] Couch was riding in a moving car as he filmed. I guess he could have jumped out of the camera car [as Wiegman did] and rush inside the TSBD to film in there or film the upper floors of the building where he saw the gun. But in the latter possibility, Couch knew the gun had already been pulled back inside, so he might have thought "What's the point of filming an empty window?" (even Dillard wasn't fast enough with his camera to capture the gun or the assassin in the window, and he snapped his picture just seconds after Bob Jackson shouted "There's the rifle!").

Plus, Couch could easily see that a lot of confusion was taking place near the Grassy Knoll (the direction his camera car was taking him anyway), so what was he supposed to do under those circumstances? He merely filmed what was handy to film at that chaotic moment, and he'd already passed the Depository.

And this quote of yours, Martin, is not an accurate (or fair) remark at all:

"This is a good example of guided testimonies of the WC." -- M. Hinrichs

How do I know it's not a fair statement? Because we don't need to rely ONLY on what Mal Couch told the Warren Commission months after the assassination. Fortunately for us, we've got the audio of Couch saying that he saw the rifle sticking out of the "fifth or sixth floor" window of the TSBD. And he said that on live WFAA-Radio within just an hour or two of the shooting on November 22nd. Listen to him say it HERE.

BTW, after Couch's camera car went under the Triple Underpass, he did jump out of the car and run back to the Depository. Here's what Couch said about that in his Warren Commission testimony:

MALCOLM O. COUCH -- "As I recall, right after we made the turn on Elm, one or two of the fellows jumped out. But after we got all the way down underneath the three trestles we finally persuaded the driver--who wasn't too anxious to stop--to stop and we all jumped out. And I ran, I guess it was about 75 yards or a little more back up to the School Depository Building and took some sweeping pictures of the crowd standing around. I didn't stay there long."

DAVID VON PEIN LATER SAID:

Why do so many conspiracy believers totally ignore Oswald's own words concerning where he said he was located at the time of the shooting?

WILLIAM KELLY SAID THIS.

DAVID VON PEIN SAID:

Since you think Oswald wasn't on the sixth floor when the assassination was taking place, then how did OSWALD'S rifle get on the sixth floor, Bill?

And why did Oswald lie about the "curtain rods"? What possible reason would Oswald have had for telling such a false tale to Buell Frazier (twice)?

And you think it's just a coincidence that OSWALD'S prints were all over the boxes in the Sniper's Nest--the same nest where Kennedy's killer was located at 12:30 PM?

My, what lucky patsy plotters.

WILLIAM KELLY SAID THIS.

DAVID VON PEIN SAID:

Sure I know all of that stuff, Bill. Does that mean I have to swallow it like you have?

WILLIAM KELLY SAID THIS.

DAVID VON PEIN SAID:

Buell Wesley Frazier, of course, did drive the rifle from Irving to the TSBD on 11/22. That fact couldn't be more obvious. And it's also obvious that the bag found on the sixth floor could easily hold Oswald's disassembled rifle, as this side-by-side photo below amply illustrates (the caption of the FBI photo is slightly off when it says that the blanket was found in "Oswald's garage"; it should say Ruth Paine's garage, of course; that is one of several errors made by the FBI during its haste in preparing its 12/9/63 report):

Tell us, William Kelly, how did Oswald's prints get on that 38-inch paper bag (CE142) if he didn't handle it at some point prior to the assassination?

Also....

We have OSWALD'S fingerprints and palmprints located on two of the boxes that were located deep within the Sniper's Nest.

Stated another way -- Lee Harvey Oswald's fingers touched the same boxes that were utilized by the person who fired a rifle at President Kennedy.

Do the math. It isn't rocket science--or even 10th grade algebra. It's 1st grade 2+2 arithmetic. You're just looking for an excuse to throw away some very incriminating evidence that corroborates and solidifies all of the other "Oswald Was Here" stuff that is also on the table.

But go ahead and play defense attorney for Oswald if that's your desire. But I doubt a jury would buy it (especially when that same jury considers whose gun deposited those three empty cartridge cases that were lying just a few inches away from Oswald's prints on those boxes).

JFK ASSASSINATION ARGUMENTS
(PART 1300)

CORY SANTOS SAID:

This photo in your blog has a questionable value UNLESS the angle is adjusted clearly for the fact that Elm slopes.

DAVID VON PEIN SAID:

The CE903 photo taken in the Dallas garage is adjusted to account for the 3.15-degree downward slope of Elm Street, making the angle through JFK's body equal to 17.72 degrees downward (as opposed to just over 20 degrees if the car had been photographed out on Elm Street).

And Gerald Ford's "move" wasn't really a physical "move" of the wound at all. It was merely semantics. It was Ford realizing that the original language couldn't possibly be accurate --- "entered his back at a point slightly above the shoulder". Ford knew that if the bullet had really entered ABOVE the shoulder, it must have entered the "neck", not the "back". Hence the change. And it made things worse, because, as we can see via the autopsy photo, the bullet did not enter the "neck". It entered the "back" (pretty much right AT the level of the shoulders).

Hence, the CTers have now been given a perfect reason to shout "Cover-up" at the top of their lungs as they get to accuse Gerald Ford of playing fast and loose with the evidence, when all he really was doing was trying to make things more accurate. But since Ford never saw the actual back-wound photo, he was really just guessing. The real "culprit" is whoever wrote that first draft of the wound location. That person had it wrong and Ford was merely trying to correct it.

JOHN BUTLER SAID:

Does the photo showing Arlen Specter and his bullet angle mean that Kennedy was shot twice in the back?

DAVID VON PEIN SAID:

No, John. It's just that the Rydberg drawings suck. (Yes, even an LNer like myself can admit that fact.)

But fortunately, Arlen Specter didn't actually rely at all (quite obviously) on the awful Rydberg drawings when he put that metal rod up against JFK's stand-in, because the wound is placed in the BACK, not in the NECK, in Commission Exhibit No. 903.

JAMES DiEUGENIO SAID:

It's hard to believe how much baloney that DVP can get into one post.

The Warren Commission did have the autopsy materials. In one of the executive sessions, McCloy asks about this point. Rankin replies that they have them for the Commission only in a room off the hall. This point is also acknowledged in the McKnight book. (This is the kind of research that this guy does.)

All of this makes this lie even worse.

DAVID VON PEIN SAID:

Jim,

The bottom line is....

The Warren Commission got it right in CE903.

You'll never admit that fact, though, of course (even though you can see it in the photo published as Commission Exhibit No. 903).

There was no wound depicted as being in the back of the "neck" in CE903. It's in the UPPER BACK, just like the autopsy photo shows.

Period.

No "baloney". Just facts---in ILLUSTRATED form, via this photo....

ZOOMED-IN VIEW:

CORY SANTOS SAID:

Was this the same limo JFK was in?

DAVID VON PEIN SAID:

No, it's the Secret Service follow-up car (the "Queen Mary"), which is a Cadillac, not a Lincoln.

But the inner seat configuration is very similar to JFK's SS-100-X limo.

CORY SANTOS SAID:

I thought so. That is cause for debate, as experiments need to be exact. Thanks for confirming that.

ADAM JOHNSON SAID:

And the sixth floor TSBD window is over Arlen Spector's [sic] outstretched left hand, I take it. LOL LOL

Go put the limo at Z220 on Elm Street and tell me if you stood beside JFK and placed this rod over his right shoulder, it would be pointing at the TSBD 6th floor.

DAVID VON PEIN SAID:

Yes, it definitely would have pointed back to the sixth floor. The "17-43-30" angle was determined while the car was out on Elm Street (prior to being taken to the enclosed garage for the CE903 photo). That fact was confirmed in the testimony of the FBI's Lyndal Shaneyfelt....

LYNDAL L. SHANEYFELT -- The average angle, allowing for the 3'9" street grade, results in an average angle between frame 210 and frame 225 of 17 degrees, 43 minutes, 30 seconds.

ARLEN SPECTER -- And that is the average angle from the muzzle to President Kennedy as he sat in the car or President Kennedy's stand-in as he sat in the car?

MR. SHANEYFELT -- That is correct. To the wound entrance.

MR. SPECTER -- Is the average angle of 17-43-30 measured from the muzzle to the President's body as the President would be seated in the car?

MR. SHANEYFELT -- That is out on the street in those frame positions, yes. It is measured to the point of the wound on the back of the President.

CORY SANTOS SAID:

But it's not the same limo. You cannot recreate an accident of a Mercedes driving a BMW because they are similar.

DAVID VON PEIN SAID:

The seating layouts of the JFK limo and the Secret Service car were very similar. And any differences were taken into account (as confirmed, again, by Shaneyfelt's testimony)....

MR. SPECTER -- Was there any difference between the position of President Kennedy's stand-in and the position of President Kennedy on the day of the assassination by virtue of any difference in the automobiles in which each rode?

MR. SHANEYFELT -- Yes; because of the difference in the automobiles there was a variation of 10 inches, a vertical distance of 10 inches that had to be considered. The stand-in for President Kennedy was sitting 10 inches higher and the stand-in for Governor Connally was sitting 10 inches higher than the President and Governor Connally were sitting--and we took this into account in our calculations.

JAMES DiEUGENIO SAID:

This is so silly. But that is Davey. Any fool, or zealot, can handle a pointer. (But note Davey never shows the reverse angle.)

DAVID VON PEIN SAID:

Totally untrue, and you know it. I've posted it (and discussed it) on my site numerous times ----> Click Here.

JAMES DiEUGENIO SAID:

False. You did not post it here [at The Education Forum]. .... One of the reasons he will not show the reverse angle here is because on that angle it's actually shown that they placed the back wound too far down for the shot of Specter to be matched up with it. As you can see from just the photo above, Lying Arlen has the rod on top of the guy's shoulder. The top of one's shoulder is at the base of the neck.

DAVID VON PEIN SAID:

Why don't you just post it here yourself? Haven't you learned how to post a picture yet?

Come to think of it, have you EVER posted any photos here? I'm not being critical of you in this regard, it's just that I can't think of any posts where you've added any pictures, which seems kind of curious, since this crime is one that has so many "photographic" aspects to it.

But since you seem to refuse to post those "opposite angle" pictures for yourself, I'll do it for you....

Also See:

http://jfk-archives.blogspot.com/CE903/Angles

JAMES DiEUGENIO SAID:

There is also this point: this picture also demonstrates the lie that the WC did not have the autopsy photos. They had to have them to get that dotted location.

DAVID VON PEIN SAID:

Totally untrue. Arlen Specter and the Warren Commission could have very easily determined the location of the back wound from the autopsy report ("14 cm. from the tip of the right acromion process and 14 cm. below the tip of the right mastoid process"). And that's no doubt what they did. Even if they did look at the autopsy photo, they wouldn't have relied ONLY on that photo. They would have utilized the best measurement for the back wound---which was in the autopsy report.

Oddly, Thomas J. Kelley of the Secret Service testified that the chalk mark was determined by just looking at the crappy Rydberg drawing and the coat of JFK --- which is ridiculous, because if only those two things were the source of the chalk mark, the mark would certainly not be in the location where we find it in CE903. Therefore, it's logical to conclude that the WC would have certainly gone to the best place for determining where on Kennedy's body the wound was located---and that's the autopsy report.

And, in fact, we find this info on Page 107 of the Warren Report, confirming what I just said above about the Warren Commission relying on the autopsy report itself....

"The wounds of entry and exit on the President were approximated based on information gained from the autopsy reports and photographs."

The above sentence could give the appearance that the Warren Commission was admitting that they had, in fact, looked at the autopsy photos. But when the WC used the word "photographs" on Page 107 of its Report, they appear (via the source note provided on Page 107) to only be referring to the crappy Rydberg drawings (see Thomas Kelley's testimony at 5 H 133-134).

But I think it's fairly obvious that Arlen Specter and the WC were definitely relying on more than just JFK's jacket and the awful Rydberg drawing (seen in Commission Exhibit No. 386). They had easy access, of course, to Page 3 of JFK's autopsy report, which clearly indicates the precise location of where a bullet had entered President Kennedy's upper back.

So it is utterly ridiculous, in my opinion, to believe that the Commission would NOT have utilized Page 3 of that autopsy report when it came time to place that chalk mark on the back of the JFK stand-in during the Warren Commission's assassination reconstruction effort in Dallas, Texas, on Sunday, May 24, 1964.

CORY SANTOS SAID:

Was this photo before or after Ford moved the location? Lol.

DAVID VON PEIN SAID:

Doesn't really matter. Because, as I just outlined above, the WC didn't really rely on the crappy Rydberg drawing at all. Because if they had relied on it, we wouldn't find the wound where it is in Commission Exhibit 903 and in all of those "opposite angle" photographs.

CORY SANTOS SAID:

The car is flat [when it was in the Dallas garage on 5/24/64], not on a downslope. You have to understand how bad this shows it's not a scientific recreation.

DAVID VON PEIN SAID:

They subtracted the 3-degree, 9-minute slope of Elm when they went to the garage. Out on the street, the angle is 21+ degrees from the sixth-floor window to the inshoot wound on JFK's back. When the slope of Elm is taken off, the angle becomes 17.72 degrees (based, of course, on the "average" angle between Zapruder frames 210 and 225, which is the "range" of frames the Warren Commission was using for the SBT hit).

And so, as we can easily see, some slack must be given to the Warren Commission's tests....because their re-creation is being based on just an AVERAGE ANGLE between Z210 and 225 in the first place. So unless JFK was hit at exactly Z217.5 (which is quite unlikely), then the angles and measurements are going to be slightly off.

But conspiracy theorists can't permit any "slack" or "leeway" to be given to Mr. Specter & Company, can they? For a CTer, if it's not 100% exact to the millimeter, then we must toss the re-enactments in the trash can. Right? Come on! That's a ridiculously rigid mindset to have. Don't you agree?

JAMES DiEUGENIO SAID:

FYI, the mastoid process is part of the ear! Why anyone would use that to locate a back wound is DVP's secret. Because it's baloney.

DAVID VON PEIN SAID:

MY secret?? You're too funny, Jim.

Anyway, don't blame me. I didn't do the autopsy. Go blame Humes for measuring from the mastoid.

(Oh, wait, you DO blame Humes, right? And he's nothing but a liar, to boot. So he's both incompetent AND a liar, correct?)

JAMES DiEUGENIO SAID:

We don't know who wrote the report we have today.

Because as Humes admitted to the ARRB, he not only deep sixed his notes, but also his original report. (McKnight, p. 165)

McKnight goes on to add that this likely happened right after the murder of Oswald in Galloway's office. (ibid, p. 163)

It's your secret since you do not divulge this information when you make your silly assertions.

INSTANT REPLAY....
JAMES DiEUGENIO SAID:

We don't know who wrote the report we have today.

DAVID VON PEIN SAID:

The above ridiculous sentence was written by a person who, just three sentences later, accused me of making "silly assertions".

Jim never gets tired of providing his readers with a non-stop flow of Pot/Kettle irony.

JAMES DiEUGENIO SAID:

Have you ever admitted on your site that Humes told the ARRB and Jeremy Gunn that he not only incinerated his notes but his original autopsy report also?

DAVID VON PEIN SAID:

Oh, sure. I certainly have. The topic of Dr. Humes burning the first draft of the autopsy report and his blood-stained notes has come up many times in the discussions I have archived at my site. For some examples, CLICK HERE.

And, BTW, Humes first testified about the burning of the first draft of the autopsy report in his 1964 Warren Commission testimony. That subject didn't first come up in the 1990s with the ARRB. Humes said this to Arlen Specter on Page 373 of WC Volume 2....

"In privacy of my own home, early in the morning of Sunday, November 24th, I made a draft of this report which I later revised, and of which this represents the revision. That draft I personally burned in the fireplace of my recreation room."

And Humes also testified in 1964 that he had "destroyed certain preliminary draft notes" (also at 2 H 373). The specific reason for the burning of the notes (the blood stains) was not mentioned by Humes in his Warren Commission testimony, however. But, as we can see, Humes admitted to having "burned" and "destroyed" both the first draft of the autopsy report and some draft notes during his WC testimony in 1964.

JAMES DiEUGENIO SAID:

Have you ever indicated on you site that his original BS story about not having the blood of the president on [the] report as a souvenir was a pile of BS since he wrote the report in the confines of his home?

DAVID VON PEIN SAID:

Dr. Humes never said the burned first draft of the autopsy report had any blood on it. The blood was only on the notes, not the "report".

DAVID VON PEIN SAID:

This first item on this page doesn't exactly qualify as an "Assassination Argument", but it's quite interesting nevertheless....

On December 18, 2019, I found something on YouTube that I had never seen before — pre-1963 motion picture film footage taken in Dallas' Dealey Plaza. This footage (starting at 4:04 in the video below) is from late May of 1960, more than three years before Dealey Plaza became widely known.

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

Almost sixty years later, all anti-SBT scenarios that have been placed on the table by conspiracy theorists have been embarrassing failures. And the reason for that is quite simple: It's because the Single-Bullet Theory is so obviously the correct solution to explain the double-man wounding of Kennedy and Connally on 11/22/63.

http://jfk-archives.blogspot.com/The Single-Bullet Theory In Action

http://jfk-archives.blogspot.com/The Ultimate In SBT Denial

-------------------------------

"Coming up with a believable and reasonable conspiracy-endorsing alternative to the Warren Commission's single-bullet conclusion is something that simply cannot be done. And that's mainly because the SBT is obviously the truth. And when you try to dismantle the truth and replace it with some kind of half-baked, incoherent "alternative theory" (such as the "TWO BULLETS WENT INTO JFK AND NEVER EXITED AND THEN DISAPPEARED" claptrap), you're not likely to find the alternative to be nearly as compelling (or reasonable) as the truth." -- David Von Pein; September 1, 2010

-------------------------------

"Isn't it rather remarkable that the person sitting in front of JFK also had a bullet wound in his upper back? Plus the added facts of JFK having a bullet hole in his throat and JFK having no bullets in his body. Conspiracy theorists who hate the Single-Bullet Theory never seem bothered in the least by those last observations I just mentioned. They'll simply add yet another bullet to the mix to account for John Connally's back wound. The SBT will never be defeated by conspiracists. And that's because the SBT will always make more sense than any anti-SBT theory. The truth usually does make the most sense, of course." -- David Von Pein; December 14, 2013

ALLEN LOWE SAID THIS.

DAVID VON PEIN SAID:

"Finally found someone who agrees..." ??

Yeah, right, Allen. There's only several million people who believe the SBT is true. And yet you seem to think that I'm in a minority of one. Much the same way Jim DiEugenio holds the wacky belief that Vince Bugliosi's book has been endorsed by just two people in the whole world---myself and Tom Hanks:

"The only person who believed it ['Reclaiming History'] was Tom Hanks." -- James DiEugenio [4/15/2010]

CORY SANTOS SAID THIS.

DAVID VON PEIN SAID:

I wasn't talking about the number of people who believe in a conspiracy, Cory. I was only talking about the SBT. And the CTer anti-SBT versions of the shooting are---unquestionably---an embarrassment. That's a fact.

What's your version of the shooting that replaces the SBT, Cory? Can you avoid the embarrassing and absurd bullet-vanishing scenarios of your predecessors?

Good luck.

CORY SANTOS SAID THIS.

DAVID VON PEIN SAID:

You must be kidding by asking me this question, Cory!

There was no "shallow wound" in JFK's back. That's part of the CTer version of events. It's certainly NOT what I believe and it's certainly NOT what the autopsy doctors concluded:

"The other missile...made its exit through the anterior surface of the neck." -- Page 6 of JFK's Autopsy Report [Warren Report, Page 543]

PAT SPEER SAID THIS.

DAVID VON PEIN SAID ALL THIS.

DAVID VON PEIN ALSO SAID:

At what point will conspiracy theorists begin to realize that their anti-SBT theories are far more ludicrous, unsupportable, and untenable than is the single-bullet conclusion endorsed by both the Warren Commission and the HSCA?

CHRIS BRISTOW SAID THIS.

DAVID VON PEIN SAID:

And I never said Dr. McClelland capitulated. In fact, that was kind of my whole point---the fact that he didn't reverse his opinion regarding the location of JFK's head wound even after seeing this autopsy photo at the National Archives:

And then, after seeing the above photo at the Archives, McClelland comes up with his "Scalp Pulled Up Over The Wound" theory, which is completely ridiculous and impossible given the wholly undamaged condition of JFK's scalp in the photo above.

Dr. McClelland was, of course, trying his best to have it both ways concerning President Kennedy's head wound. But when logic and common sense enter the equation, it's quite clear that having it both ways is just not possible in this instance.

Also, please inform me as to how and where I have engaged in "a complete misrepresentation of McClelland". I look forward to seeing that.

I think you must be referring to other Lone Assassin believers who have stated in the past that McClelland completely reversed his position regarding JFK's head wounds in the 1988 NOVA Special. Because I have never said any such thing about Dr. Robert N. McClelland.

CHRIS BRISTOW SAID THIS.

DAVID VON PEIN SAID:

That's quite alright, Chris. And thank you for admitting you were mistaken. That's a refreshing thing to see here once in a while. 😁

JOSEPH McBRIDE SAID THIS.

JOSEPH McBRIDE SAID THIS.

DAVID VON PEIN SAID:

You're incorrect on this, Joe. Nobody gave Jackie a "Lambchop puppet" at Love Field, and that fact is proven in the film clip shown below. In this video clip, Jackie is clearly handling a cluster of flowers and not any kind of toy or puppet just after she enters the limousine at Love Field:

Photographs taken at Love Field (like the one shown below) also tend to debunk the notion that there was a "Lambchop" toy.

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

The curtain rod "story" was most definitely a "story" (i.e., lie) invented by just one person---Lee Harvey Oswald. And unless conspiracy theorists think Buell Wesley Frazier was lying his ass off when he used the words "curtain rods" three separate times in his 11/22/63 affidavit (pictured below), then it's pretty obvious where the curtain rod "story" originated.

SANDY LARSEN SAID THIS.

DAVID VON PEIN SAID:

Of course Oswald didn't eat lunch on the first floor after his encounter with Officer Baker. That was merely one of the many lies Oswald told the police after his arrest.

Oswald also didn't "stand around for five or ten minutes with foreman Bill Shelley" after the encounter with Baker either, which is yet another of Lee Oswald's lies that appears in James Bookhout's 11/22/63 solo FBI report.

One of the very few things that Oswald didn't lie about after he was arrested, however, was his encounter with Officer Baker in the lunchroom. And that's because he had no reason whatsoever to want to lie about that particular event. And he also knew he couldn't very well lie and say the encounter never took place at all, because there were two witnesses (Baker and Truly) who could easily prove that such an encounter did take place.

In order to believe that the authorities just MADE UP the Baker/Truly/Oswald lunchroom encounter from whole cloth, you'd have to believe (as many conspiracy theorists do) that BOTH Roy Truly and Marrion Baker were big fat liars, which is an absurd belief (for all the reasons discussed at the link below).

DAVID VON PEIN LATER SAID:

If Lee Harvey Oswald had said to Captain J.W. Fritz (et al) that he was outside on the steps at the time of the shooting, that key information would most certainly have shown up in the official reports of multiple people who were present to hear Oswald's statements during the interrogations (e.g., the reports of Fritz, Bookhout, Hosty, Kelley, and Holmes).

Instead, we have this:

"I [Captain Fritz] asked him [LHO] what part of the building he was in at the time the President was shot, and he said that he was having his lunch about that time on the first floor." [Warren Report; Page 600]

And this:

"Oswald claimed to be on the first floor when President John F. Kennedy passed this building." [Hosty/Bookhout 11/22/63 joint report; WCR, Page 613]

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

Actually, Pat, Joe Ball didn't need to "trick" Buell Frazier into saying any such thing....because Frazier himself had already admitted to the FBI---months earlier, on December 1, 1963---that the bag found in the Sniper's Nest (CE142) "could have been" the same bag Frazier saw Oswald carrying on the morning of the assassination. That "could have been" information was brought out in Bardwell Odum's 12/1/63 interview with Frazier, which can be found here in Commission Document No. 7....

"Frazier examined the original [brown paper sack] found by the sixth floor window of the TSBD Building on November 22, 1963, and stated that if that sack was originally the color of the replica sack, it could have been the sack or package which he saw in the possession of Oswald on the morning of November 22, 1963, but that he does not feel he is in a position to definitely state that this original is or is not the sack."

BTW, Linnie Mae Randle said the same thing about the original paper bag (see this page of CD7).

The "original" paper bag, with two of Lee Oswald's fingerprints on it, is 38 inches long.

So much for the bag being only "27 inches" or "2 feet" long.

The two 12/1/63 FBI interviews with Frazier and Randle that I just linked to are quite revealing and important, in my opinion, because when both Frazier and Randle were shown the "original" paper bag found in the Sniper's Nest (which is, indeed, a 38-inch bag), they both told Bardwell Odum and one other FBI agent that the "original" bag could have been the same one they saw Oswald carrying. Now, why would they BOTH have said something like that to the FBI if the bag they each saw on November 22nd had really been almost a foot shorter than the 38-inch "original" bag they were shown by the FBI?

If the bag that Linnie Mae Randle and Buell Wesley Frazier saw Lee Oswald carrying had really been quite a bit shorter than the "original" bag they were both later shown on December 1st, then there should have been no "ifs" and "coulds" about it in either Randle's mind or Frazier's mind—because the "original" bag (via those conditions) could not possibly have been the bag that Frazier and Randle saw on Nov. 22, regardless of the bag's COLOR.

But instead of saying to the FBI agents something like this....

Regardless of the color issue, there's no way in the world this "original" bag you are showing me now could be the same one I saw Oswald carrying on Nov. 22nd, because this "original" bag is way too long.

....both Frazier and Randle, per Commission Document No. 7, tell two FBI agents that the "original" bag they were shown is still in the mix of possible bags that Lee Oswald "could have been" carrying on November 22nd.

Do conspiracy theorists think that both Buell Frazier and Linnie Randle just TOTALLY IGNORED the LENGTH of the "original" bag when they each said that the original sack was still a candidate for the one they saw Oswald toting on 11/22? Were both Frazier and Randle only concerned with the COLOR of the bags at that point in time in their FBI interviews?

In other words, both Buell & Linnie Mae knew the original bag was much too long, but neither one of them was able to concentrate on two separate aspects of the bag at the same time (color and length), so they each said "could have been" with respect to the color only, all the while totally forgetting that this "original" bag in front of their eyes was entirely too big. Is that what some conspiracists want to contend?

Or maybe some CTers think that FBI agents Bardwell D. Odum and Gibbon E. McNeely were merely putting words into the mouths of both Buell and Linnie Mae that neither of them actually uttered at all during their 12/1/63 interviews --- namely these words: "Could have been the sack".

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

Oh yes, it's certainly very true that Buell Wesley Frazier has always strongly suggested that the bag he saw Oswald carrying into the Book Depository on 11/22 was way too short to be the bag that was found by the police in the Sniper's Nest (CE142).

But those FBI reports in CD7 have got to make you scratch your head just a little bit, though. Because if LHO's bag had really been only 24 to 27 inches in length, why would BOTH Frazier AND Randle have told the FBI that CE142 could have been the bag they saw Oswald carrying---regardless of the color?!

Plus, there's another FBI report from 11/22/63, in which Linnie Randle told James Bookhout that the bag she saw Oswald carrying was "approximately 3 feet" (36 inches) in length. And that was her very first approximation of the bag's size.

MARK KNIGHT SAID THIS.

DAVID VON PEIN SAID:

If JFK had been hit as early as Z190, we would not have him waiting until Z226 to jerk his arms upward toward his throat. No way. No how. If that arm movement was involuntary (and I certainly think it was involuntary), then such a reaction would be as immediate as humanly possible....which is precisely what we see in frames Z225 to Z230 of the Zapruder Film.

In a gunshot wound incident like this, a two-second delay is practically forever.

And when speaking about Jackie Kennedy's reactions, I'll remind you that I did say this in my previous post regarding that matter....

"...we ARE only talking about 1.86 seconds in real time--between Z190 and Z224..."

DAVID VON PEIN SAID:

Frankly, Gerry, I don't think there's anything particularly "odd" about JFK's movements just prior to the time he disappears behind the sign. And I can't see any odd facial expression being exhibited by JFK at that time either. But it is very difficult to discern any facial details at that point in the film, since the limousine is further away from Mr. Zapruder's camera than it is just a few seconds later.

When comparing the Z-Film's "pre-sign" frames with the "post-sign" frames, it looks to me as if Kennedy's right arm is in pretty much the very same position AFTER he emerges from behind the Stemmons sign as it was before going behind the sign. And Dale Myers pretty much confirmed this fact years ago when he did his "interpolation" work to study the movements of both Kennedy and Connally in the Zapruder Film.

Myers said this (on his FAQ page at his "Secrets Of A Homicide" website):

"When the sequence is viewed without the sign's interference, it is clear that the interpolated motion forms a contiguous bridge between the known actions of the two men as seen both before and after the Stemmons freeway sign. In short, Kennedy and Connally made no large, dramatic movements while hidden from Zapruder's camera." -- Dale K. Myers

DAVID VON PEIN SAID:

"As more and more time goes by, and as more and more convincing tests are produced that verify the factual nature of the Single-Bullet Theory (e.g., Dale Myers' excellent computer animation work and the 2004 Discovery Channel SBT re-creation in "JFK: Beyond The Magic Bullet"), it's my personal opinion that conspiracy theorists totally ignore the validity of the SBT merely because they think it's expected of them. They wouldn't be good "CTers" if they dared put any faith in anything Mr. Specter or Mr. Redlich or Mr. Belin said. So they are forced to discount the SBT as pure junk out of sheer habit.

But it certainly isn't out of necessity that the conspiracists scoff at the SBT. Not at all. For, the CTers can still pretend they see J.D. Tippit or some other "Badge Man" firing a shot from the Grassy Knoll...even WITH the Single-Bullet Theory intact."

SEAN COLEMAN SAID THIS.

DAVID VON PEIN SAID:

Sean,

The Warren Commission definitely was NOT forcing itself into accepting the Single-Bullet Theory at all costs due to the existence of James Tague. How do we know what I just said is true? Because of Page #117 of the Warren Report itself, which states quite clearly and directly that the Commission was readily acknowledging the possibility that the damage to the Main Street curb (and, hence, the wounding of bystander James T. Tague) could have very well been caused by a fragment from the HEAD SHOT.

Therefore, via a possible scenario of Tague being wounded by a head-shot fragment, the SBT is not a MANDATORY conclusion to reach to still arrive at a final conclusion of Lee Harvey Oswald acting alone.

I, myself, do think that the Single-Bullet Theory is mandatory in order for Oswald to be the lone assassin of President Kennedy. But the Warren Commission's collective opinion was not as strict and restrictive as my own on the SBT matter....and Page 117 of the Warren Report (seen below) proves that fact.

RON EGE SAID THIS.

DAVID VON PEIN SAID:

Even an alternate version of the SBT would make much more sense than what most CTers seem to believe---which is that JFK & Connally were struck by at least THREE different bullets instead of just the one CE399 missile.

My point was: You can still very much be a conspiracy believer ("CTer") and yet still believe the SBT is true as well.

There's nothing in the JFK Assassination Manual (that I'm aware of) that prohibits a conspiracy advocate from endorsing the Single-Bullet Theory (whether it be the Warren Commission's version of the SBT or another version of a "single-bullet" conclusion).

And, frankly, it's always puzzled me as to why there aren't far more conspiracy believers endorsing the SBT. Because, in my opinion, Vincent Bugliosi was 100% correct when he said that "a child could author it" [the SBT]. [The full Bugliosi quote is below.]

"From the first moment that I heard that [Arlen] Specter had come up with the single-bullet theory, it made very little sense to me since the theory was so obvious that a child could author it. .... Since [the members of the Warren Commission staff] all knew that the bullet, fired from Kennedy's right rear, had passed through soft tissue in Kennedy's body on a straight line, and that Connally was seated to the president's left front, the bullet, after emerging from Kennedy's body, would have had to go on and hit Connally for the simple reason it had nowhere else to go. How could it be that among many bright lawyers earnestly focusing their minds on this issue, only Specter saw it? .... When I asked [Norman Redlich on September 6, 2005] if, indeed, Arlen Specter was the sole author of the single-bullet theory, his exact words were, "No, we all came to this conclusion simultaneously." When I asked him whom he meant by "we," he said, "Arlen, myself, Howard Willens, David Belin, and Mel Eisenberg"." -- Vincent T. Bugliosi; Pages 302-303 of Endnotes in "Reclaiming History"

MICHAEL GRIFFITH SAID THIS.

DAVID VON PEIN SAID:

Given the alignment of the two limo victims at the time of the shooting, plus the location of the only known shooter in Dealey Plaza, plus the fact that no bullets were found in JFK's body at all, plus the fact that a whole bullet which positively came out of the gun that was found on the sixth floor of the TSBD was found inside the hospital where the two victims were taken, plus the fact that the two injured limo victims reacted to an external stimulus at precisely the same moment in time on the Zapruder Film....I wonder how anyone in 2022 (or any other year or millennium) can be so blind as to not accept the Single-Bullet Theory as fact.

BENJAMIN COLE SAID THIS.

DAVID VON PEIN SAID:

I have no idea why you're labeling it "the DVP version", because the version of the SBT that you're talking about in your post above (as it relates specifically to Governor Connally having the ability to turn completely around in his seat AFTER being hit in the back, wrist, and leg by a bullet) is exactly the same as the Warren Commission's version and even the HSCA's version.....because both the WC and the HSCA also concluded that Gov. Connally definitely DID turn around in his seat and stare right at JFK at a point in time after Connally had been hit by the one and only bullet that pierced his body.

But it's still okay with me if you want to call it the "DVP Version". I like being associated with something filled with so much common sense and logic (plus the number of whole bullets that are in evidence---one).
