JFK ASSASSINATION ARGUMENTS
(PART 954)

PAT SPEER SAID:

FWIW, I was onto Bugliosi's book from before it was even finished. I sent him a number of letters trying to get him to come to his senses. To no avail.

DAVID VON PEIN SAID:

Thank heaven for that. Because if Pat Speer had gotten Vince to "come to his senses", Vince would have been believing in make-believe bullet holes in the back of President Kennedy's head that nobody else but Pat Speer can see....fake paper bags....and God knows what else.

PAT SPEER SAID:

I knew he wasn't gonna go all CT all of a sudden. As I recall, I sent him some material about the EOP entrance/cowlick entrance. I had hopes he would take a look at it and announce that the bullet entered by the EOP after all. It turned out he refused to go down that road even though two of his consultants (Sturdivan and Zimmerman) similarly urged him to do so. It's too bad. His book could have been on the right side of history on at least one point.

I'm fairly certain he never even saw what I sent him. One envelope came back Return to Sender. The other received no response.

DAVID VON PEIN SAID:

Why on Earth would Vince have done something dumb like that when he had this picture to look at, which proves beyond all reasonable doubt that the bullet entered near the cowlick?....

PAT SPEER SAID:

There is a red oval in this photo [seen above] that resembles a gunshot wound. But it was not the bullet wound identified at the autopsy. If Bugliosi had a lick of sense he would have realized that.

[...]

The cowlick entrance was a myth from the get-go, that has now been abandoned by the myth-makers. Heck, even Fox News figured this out in their 50th anniversary special. Catch up.

DAVID VON PEIN SAID:

Yeah, yeah. Sure, Pat. That's why there's a ruler up next to the red spot. And that's why the red spot is the ONLY thing in that picture which comes even close to resembling a bullet hole. And that's why the HSCA and the Clark Panel BOTH confirmed via multiple measurements (in both the SCALP and the SKULL) that the entry wound on the back of President Kennedy's head was located approximately 100mm. above the EOP.

1978 HSCA Interview With Dr. Pierre A. Finck

The Clark Panel Report

Excerpts from the Clark Panel Report (which is a 1968 report that will forever be ignored or deemed worthless by various conspiracy theorists, including Mr. Patrick J. Speer)....

"One bullet struck the back of the decedent's head well above the external occipital protuberance. Based upon the observation that he was leaning forward with his head turned obliquely to the left when this bullet struck, the photographs and X-rays indicate that it came from a site above and slightly to his right. This bullet fragmented after entering the cranium, one major piece of it passing forward and laterally to produce an explosive fracture of the right side of the skull as it emerged from the head.

[...]

On one of the lateral films of the skull (#2), a hole measuring approximately 8 mm. in diameter on the outer surface of the skull and as much as 20 mm. on the internal surface can be seen in profile approximately 100 mm. above the external occipital protuberance. The bone of the lower edge of the hole is depressed. Also there is, embedded in the outer table of the skull close to the lower edge of the hole, a large metallic fragment which on the anteroposterior film (#1) lies 25 mm. to the right of the midline. This fragment as seen in the latter film is round and measures 6.5 mm. in diameter.

[...]

The foregoing observations indicate that the decedent's head was struck from behind by a single projectile. It entered the occipital region 25 mm. to the right of the midline and 100 mm. above the external occipital protuberance. The projectile fragmented on entering the skull, one major section leaving a trail of fine metallic debris as it passed forward and laterally to explosively fracture the right frontal and parietal bones as it emerged from the head."

PAT SPEER SAID:

There is a 3-D morph of the photo you posted and [the] black and white [autopsy photo] on my website that similarly proves there is no hole in this location.

DAVID VON PEIN SAID:

You're dreaming, Pat. This 3D GIF, created by John Mytton, clearly shows the entry hole high on the head near the cowlick---in stereo yet....

PAT SPEER SAID:

There is a red oval in the back of the head photo that resembles a gunshot wound. But it was quite clearly not the bullet wound identified at the autopsy. You seem to think it is...

DAVID VON PEIN SAID:

Pat,

Okay, I'll stop you right there. You readily acknowledge the fact that the "red oval" in the autopsy photograph below "resembles a gunshot wound".

So, here's a simple observation and what I think is a very logical (and basic) question to ask after reading your quote above....

Since there is a spot on the back of JFK's head that DOES look like it could be a bullet hole---and since we both KNOW for a fact that there WAS, indeed, one single bullet hole of entry on the back side of President Kennedy's head---then what do you suppose the chances are of the thing that "resembles a gunshot wound" in the autopsy photo really NOT being a bullet hole in JFK's head after all?

Seems like a fair question to me. And I don't think it's a question that can be reasonably answered in the following manner (as some CTers and LNers seem to want to do).....

Well, DVP, the red spot only LOOKS like a bullet hole. The REAL bullet hole is hiding somewhere else in that autopsy picture. It's just a coincidence that the red spot (of blood?) in the photo just happened to take the form and general shape and appearance of a bullet hole. Whereas the REAL bullet hole, which cannot be seen at all in the picture (or at least most people have a hard time seeing it, except perhaps Patrick J. Speer) has decided to go AWOL from the photo, with no "redness" or other qualities to it at all that can be easily noticeable, even though that photo was taken under very good (and bright) lighting conditions. ~shrug~

[End Silly Explanation.]

So I'm just trying to wrap my head around the notion that the thing that looks like the bullet hole in the back of JFK's head really isn't a bullet hole at all. But at the same time, there really is a bullet hole of entrance somewhere else on the back of JFK's head in the above photograph.

What an amazing piece of unintentional and miraculous photographic misinterpretation that would turn out to be indeed, if it is to be believed. And, amazingly, Pat Speer (and many other CTers and LNers) actually do believe in it. I, however, cannot stretch unbelievable coincidence quite that far.

The red spot, in my opinion, is definitely the bullet hole.

PAT SPEER SAID:

BTW, I hope you realize that the HSCA FPP was an extension of the Clark Panel, and that claiming their findings support the Clark Panel is like saying "WHOA! Dick Cheney agrees with George Bush, so there's gotta be WMD's in Iraq!"

DAVID VON PEIN SAID:

The garbage about the HSCA licking the bootstraps of Fisher's Clark Panel just so that Baden & Co. wouldn't have to disagree with the Almighty Dr. Fisher in public is, as I say, garbage. The two panels were independent panels (Clark and the HSCA's Forensic Pathology Panel). One wasn't required to bow down to the other. Such a notion is preposterous. In other words, it's just one more conspiracy myth to add to the sky-high stack of conspiracy-laced myths that never die in this case.

JON TIDD SAID:

DVP,

Who took the color photo in question?

DAVID VON PEIN SAID:

Jon, as far as I know, it was taken by John Stringer.

JON TIDD SAID:

Has John Stringer ever said he took the photo in question?

DAVID VON PEIN SAID:

I'm not sure, Jon.

But there's this from Vince Bugliosi's book....

"Only four people in the autopsy room [had a close-up view of the president's head], the three autopsy surgeons and John Stringer, the chief medical photographer for the navy at the autopsy who took the only photographs of the president's head. When I spoke to Stringer [by telephone on September 21, 2000], he said there was "no question" in his mind that the "large exit wound in the president's head was to the right side of his head, above the right ear."

And in an ARRB interview on April 8, 1996, Stringer said, "There was a fist-sized hole in the right side of his head above his ear."

Though...Stringer's recollection of matters is questionable, he said he remembers this very clearly. When I asked him if there was any large defect to the rear of the president's head, he said, "No. All there was was a small entrance wound to the back of the president's head. During the autopsy, Dr. Humes pointed out this entrance wound to everyone.""
-- Pages 409-410 of Vincent Bugliosi's "Reclaiming History"

-------------------

And there's also this....

"Not only do the autopsy photos and X-rays definitively show that the entrance wound is in the upper part of the president's skull, but they show a bullet track (deposit of small metal fragments as the bullet proceeded forward) only in the upper portion of the skull. Additionally, if the bullet had entered the president's skull at the lower point the autopsy surgeons said it did, there would have been damage to the cerebellum, the lower part of the brain, which there was not. Dr. Baden testified that his forensic pathology panel "did not see any photographic or X-ray evidence...indicating any injury of the brain other than the extensive damage to the right upper part of the brain, consistent with the upper track which the panel agrees to."

In concluding that the autopsy surgeons were wrong about the precise location of the entrance wound (as described in the autopsy report), the HSCA also noted that photographs show the lower area of the president's brain to be "virtually intact"—an impossibility had the bullet entered the skull as low as the three autopsy pathologists contend."
-- Page 395 of "Reclaiming History"

The above link includes a July 1996 interview with autopsy photographer John Stringer.

DAVID VON PEIN LATER SAID:

This whole topic about the location of the entry wound on the back of President Kennedy's head is, of course, only an academic one in the first place. Because even if by some miraculous act of God or prestidigitation the bullet hole of entry in JFK's cranium was located low on his head, instead of high on his head as the photographs amply illustrate, it wouldn't change the status of Lee Harvey Oswald's lone guilt one solitary bit. Because either entry site on JFK's head is still perfectly consistent with a conclusion of Oswald shooting the President from the sixth floor of the Book Depository Building.

Back to Vince for a moment....

"Is it possible we are talking about two separate wounds to the back of the head? No. All seventeen pathologists said there was only one gunshot wound to the back of the president's head. So, by definition, we have to be talking about the same wound. Moreover, the fourteen pathologists who followed the three autopsy surgeons were able to demonstrate that the wound they found was the same wound (same dimensions) the autopsy surgeons described in their report." -- Vincent Bugliosi; Page 395 of "Reclaiming History"

SANDY LARSEN SAID THIS.

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

I have frequently experienced that exact type of attitude being aimed at me by conspiracy theorists during the last 20+ years—at this forum and also at every other Internet forum I've joined since 2003—without exception.

Most CTers I've encountered just simply cannot stand having their unprovable and untenable theories torn to shreds by anyone—be it an LNer or a fellow CTer like Patrick J. Speer. Such conspiracists prefer fantasy over reality (and facts).

Sad indeed. But that's the way it is. At least that's been my experience since plugging in my first computer in September of 2000.

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

Well, Pat, given the wholly-untenable alternative(s) that would have no choice but to be true in order for the Single-Bullet Theory to not be true, I do indeed believe that the SBT can be categorized as more of a "fact" versus merely a "theory".

After weighing all of the possible options and alternatives, it couldn't be clearer to me that the single-bullet conclusion is by far the best solution. And it's rather incredible to me that so many people have such a hard time seeing the obvious truth that resides within those three controversial letters—S.B.T.

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

1. The Rydberg drawings are, of course, a total mess. Both of the entry wounds are in the wrong place. Those drawings are completely worthless and useless. But I think the Warren Commission was doing the best they could with what they had....i.e., the memory of Dr. Humes and the total lack of relying on the best evidence for the wound locations---the autopsy photos.

The silliness of the WC's decision to not rely on or thoroughly review the autopsy photos still boggles the mind. A crazy, nutty decision to be sure. So, the LNers and CTers are therefore left to fight about the awful Rydberg drawings.

2. Re: the strap muscles and Arlen Specter's placement of those muscles. It's not that important in the long run, in my view, because the totality of the evidence indicates that the bullet which struck JFK in the upper back most certainly did make its way thru Kennedy's upper body without hitting any bone and without doing any severe damage to any internal structures in the body. And this is true regardless of the precise location of the strap muscles.

Key Fact Reminder --- No bullets were found in JFK's body. That's a fact, and it's a fact that most certainly supports the idea that one bullet traversed the President's upper body from back to front. (And I don't think it's a very good idea to utilize Paul Landis' recent 2023 anti-SBT story. Here's why.)

3. Dr. John Lattimer's work on the JFK case was quite solid and factual (IMO). CTers, of course, totally disagree. Like Lattimer, I believe the bullet (CE399) did, indeed, traverse JFK's upper back and neck and emerge from the throat intact to go on and hit John Connally. No other alternative, IMO, comes even close to matching the known facts (and wounds) in this case.

4. Re: Dr. Vincent P. Guinn and his NAA studies --- Let's all ponder the "What Are The Odds?" question after probing Dr. Guinn's findings HERE.

5. Yes, in my opinion, the HSCA was most certainly incorrect in its assessment that JFK was showing signs of being struck by a bullet as early as Zapruder frame 190. And I think the proof that the HSCA was dead wrong about that timing issue can be found later in that same Zapruder Film, in frames 224 thru 226. Because if Kennedy was hit as early as Z190, then there's no way we'd be seeing JFK doing what he's doing with the hands as late as Z226. That jerking upward of his hands would certainly have occurred well prior to Z226 if he had been hit as early as Z190.

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

Well, Pat, let's assume just for the sake of this discussion that Dr. Guinn was, indeed, a big fat liar (as you apparently believe). I'd still like to know what you think the odds are of a multi-gun conspiracy taking place in Dallas, with bullets from more than just a single rifle striking the two limo victims, and yet, after the bullets stopped flying, NOT A SINGLE BULLET OR FRAGMENT from any non-Oswald gun turned out to be large enough to be tested in order to positively eliminate Oswald's rifle as the source for ALL of the bullets and fragments that hit any of the victims on Elm Street?

I think that's an important "What are the odds?" question to ask, because that's precisely what did occur in this JFK murder case. No bullets or fragments exist in this case that were definitely determined to be from some OTHER non-Oswald gun.

With or without any Neutron Activation Analysis entering into the discussion, what I just said above is a proven fact. And it's a proven fact that conspiracy believers should be a little concerned about. Wouldn't you agree?

And the traditional CTer responses of "Nothing in this case can be trusted" and/or "Everything's been faked" are worn-out and unprovable responses that reek of conspiracy theorist desperation. Would you not agree, Pat?

SANDY LARSEN SAID THIS.

DAVID VON PEIN SAID:

And, of course, it is YOU (and you alone) who now gets to decide who has "lied" and who hasn't, is that it?

And a member now gets punished for expressing his OPINION about a particular subject, eh?

Pat seems to really believe that McClelland (in his initial report) was talking about a large wound in the left temple. I think Pat is dead wrong on this McClelland/Left Temple subject. McClelland's "left temple" reference, as you and others have correctly pointed out earlier, was referring to the alleged ENTRY wound that McClelland said was being pointed out by Dr. Jenkins.

This was, of course, all just one big misunderstanding on McClelland's part. But Pat Speer evaluates this situation differently. And Pat's certainly entitled to his opinion....as am I and all other EF forum members.

So what it boils down to is ---- You, Sandy, are penalizing Pat for having a different opinion than yours. I don't think that's fair.

SANDY LARSEN & PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

It's kind of fun watching two conspiracy theorists calling each other liars on a daily basis now. I'm enjoying it. Even though such accusations are, of course, in direct violation of one of the most fundamental rules of this forum [The Education Forum]....

"No member is allowed to accuse a fellow member of lying." -- Education Forum Rules and Membership Behaviour *

But I guess if you're a moderator (or two), you can get away with such infractions. And maybe that's why we can now write out the word LIAR at this forum without it being X'ed out. Perhaps the mods removed that restriction so they themselves can utilize that word more often and more freely (on each other). Nice. 😁

* This forum rule about calling members liars has now been reworded by Administrator/Moderator Sandy Larsen. The new rule, put in place about an hour after Larsen decided to call Pat Speer a liar in one of his forum posts, now reads like this:

"No member is allowed to accuse a fellow member of posting a falsehood without definitive proof of it being so."

And Sandy Larsen seems to think that he has "definitive proof" that Pat Speer lied in various forum posts.

What a crock. **

** Within minutes of my posting the words "What a crock" on the forum, Sandy Larsen deleted my entire post and imposed this penalty against me, prohibiting me from posting on The Education Forum for 24 hours.

That was Crock #2 for the day.

Ah, well....such is life at a JFK Assassination Internet forum. 😁

SANDY LARSEN SAID THIS.

DAVID VON PEIN SAID:

You, Sandy Larsen, just don't seem to understand Pat Speer's basic point.

I think Pat is most definitely incorrect regarding his evaluation of the "McClelland/Left temple" matter. Pat is overstating the importance of this brief hospital admission note.

Plus, after reading over that admission note again just now, it's fairly clear that Dr. McClelland does tell us, on Page 1 of the two-page admission note, that he did, indeed, see a large wound in President Kennedy's head when he says that JFK had suffered "a massive gunshot wound of the head". McClelland just didn't give the specific details concerning the exact location of where that "massive wound" was situated on the President's head.

And I don't think that McClelland's reference to a "left temple" wound on Page 2 of his admission note is referring to the "massive gunshot wound of the head" that he mentions on Page 1. I think the (erroneous) "left temple" reference is meant to indicate the place on JFK's head where Dr. McClelland at that time (at 4:45 PM on 11/22/63) thought the bullet had entered the President's head.

But at least I understand the basic point that Pat Speer is trying to get across (even though Pat is wrong, IMO). You, Sandy, apparently cannot grasp that point at all.

================================

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

A couple of basic (common-sense) facts that CTers never want to acknowledge:

1. There were no bullets in President Kennedy at his autopsy.

2. There wasn't enough damage in Kennedy to account for a bullet just stopping on a dime inside JFK's body, let alone TWO missiles performing such a ridiculous task. (And by far the favored theory amongst CTers is the proverbial "Two Bullets Entered JFK But Neither One Exited" load of bunk.)

And, of course, the Clark Panel DID find a "track" between the throat wound and the back wound:

"There is a track between the two cutaneous wounds as indicated by subcutaneous emphysema and small metallic fragments on the X-rays and the contusion of the apex of the right lung and laceration of the trachea described in the Autopsy Report." -- Clark Panel Report

(Now awaiting Pat Speer's regularly scheduled trashing of the Clark Panel's report and its top member.)

MICHAEL CRANE SAID THIS.

DAVID VON PEIN SAID:

You're propping up early erroneous information, Michael. And you surely know it's erroneous. There was no bullet "lodged behind the President's ear". And that fact was proven at the autopsy.

Why should I believe all three autopsy surgeons lied about many things concerning the autopsy?

If you want to think they all lied....fine. But I'm not travelling down that road.

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

But don't forget the one thing that the autopsy surgeons relied on (probably above all others) that resulted in those doctors concluding that the bullet exited Kennedy's throat (after Humes talked to Dr. Perry on Saturday morning, that is):

Common sense.

It's just a shame that that particular commodity is in such short supply amongst JFKA conspiracy theorists.

TOM GRAM SAID THIS.

DAVID VON PEIN SAID:

Yes, Tom, I agree with you about LNers not really being in agreement with the HSCA when it comes to some of the details associated with the SBT. I'm certainly not in agreement with the HSCA on multiple things. Such as:

1.) The HSCA's Z190 timing for the SBT, which is totally Ludicrous. (Especially when taking into account the very low position of JFK's arms almost two full seconds later, at Z224.)

2.) The HSCA's "leaning forward" status of JFK during the SBT timeframe --- Ludicrous (and provably wrong, per the Zapruder Film).

3.) The HSCA's determination that JFK's back wound was actually anatomically LOWER on Kennedy's body than the throat wound --- Wrong (and I would say provably wrong, as I discuss here).

But....

When all was said and done....and after ALL of the evidence was examined by the HSCA (including the medical evidence)....the House Select Committee did still conclude that Bullet CE399 did, indeed, go through the bodies of both President Kennedy and Governor Connally.

So the HSCA definitely got the final conclusion correct, but they certainly arrived at that conclusion in some very strange ways.

DAVID VON PEIN SAID:

Re: the color of the sixth-floor assassin's clothing....

I believe Oswald was probably wearing only his white T-shirt when he shot JFK. (With Oswald's brown shirt sitting on the floor or on top of a box in the Sniper's Nest during the actual shooting.)

And, therefore, via such a shirt scenario, Howard Brennan would be correct about Oswald not wearing the brown "arrest" shirt at the moment of the shooting itself.

RON BULMAN SAID THIS.

DAVID VON PEIN SAID:

It's just my own theory of what I think happened. It's not really the type of thing you can "cite" for.

I think Oswald shot JFK while wearing only his white T-shirt. (And there are a few witnesses who said the 6th-Floor sniper had on "light colored" clothing, which would be helpful to the "T-shirt" theory.)

I think Oswald then used his brown shirt as a fingerprint-wiping rag as he raced to the northwest corner of the sixth floor after the shooting (although, yes, he missed the prints on the trigger guard). And that, IMO, is how the fresh fibers from his brown shirt got wedged under the butt plate of the rifle.

Oswald then dumped the rifle amongst the book stacks near the northwest stairwell, and as he went down the stairs, he hurriedly put his brown shirt on, but leaving it untucked and unbuttoned as he entered the second-floor lunchroom.

Hence, Officer Marrion Baker testified in this manner concerning the brown item of clothing he saw Oswald wearing when they were together in the lunchroom on November 22nd:

"I assume it was a jacket, it was hanging out." -- Marrion L. Baker [3 H 257]

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

So you say. I disagree.

And it certainly IS a matter of "opinion". Because none of us can KNOW for certain what parts of the rifle Oswald might have missed when (or if) he tried to hurriedly wipe his prints off the gun in a frenzied dash across the 6th floor.

You, Pat Speer, are placing a level of "It didn't happen" certainty on this topic that you cannot possibly prove.

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

Go tell that to Oswald ["Fingerprints would not adhere to the wood stock."].

Oswald might very well have felt it was necessary to wipe down the rifle's wooden stock. We can't know what he was thinking when it comes to the parts of the rifle that he might have thought fingerprints would adhere to.

Also....

The fact that there were fresh fibers matching Oswald's brown arrest shirt wedged into a surface of the C2766 rifle is, in my opinion, pretty good circumstantial evidence that Oswald did, indeed, utilize that brown shirt to wipe off the gun on 11/22. Otherwise, how did the shirt fibers manage to firmly wedge themselves onto the rifle?

Yes, I know that you, Pat, think the fibers were planted onto the rifle by the evil DPD. But that's a theory that only a desperate CTer would come up with. So, IMO, that ridiculous theory about the cops wanting to plant some fibers under the butt plate of the rifle is something that (to use Pat Speer's own words in a post to me earlier) "did not happen".

Yes, there are certainly other legitimate (non-planting) ways for the fibers to have gotten there other than using the shirt as a print-wiping tool. But my theory has some weight too. And it can't possibly be totally disproved.

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

That's a nice hunk of irony there, Pat. Because, IMO, it's Patrick J. Speer (not DVP) who belongs in the "desperate" category when it comes to the topic of "How Did The Shirt Fibers Get On The Rifle?"

My theory regarding that topic isn't nearly as desperate as yours.

But, of course, it doesn't make a bit of difference whether my theory regarding the shirt fibers is correct or not. Because Oswald's guilt in the JFK murder has been established beyond all reasonable doubt---even without wiping down the gun.

BENJAMIN COLE SAID THIS.

DAVID VON PEIN SAID:

I haven't the slightest idea [why Dallas Police Department Sergeant Gerald L. Hill told author Dale K. Myers in 1996 that he had looked at the bottom of the bullet shells that littered Tenth Street after Officer J.D. Tippit was killed]. But Hill said something completely different here.

BENJAMIN COLE SAID THIS.

DAVID VON PEIN SAID:

I'll try.

And you are right to scold me regarding Gerald Hill. He told Dale Myers one thing in 1996, but three years earlier he told the Sixth Floor Museum something else entirely. And as of this date it's just not possible to figure out why. Therefore, we're left with a conflicting record.

But I do not categorize Gerald Hill as a "liar". The same thing applies to Buell Frazier, who also has told conflicting tales over the years about various things. But I wouldn't classify Buell as a deliberate liar either.

DAVID VON PEIN SAID:

While looking at some old newspapers today (March 9, 2023), I found this very interesting UPI article in the July 22, 1962, edition of The Cincinnati Enquirer (also seen below).

The article is titled:

"Would-Be Assassins Show Rise
But Kennedy Is Protected"

Here's one of the intriguing nuggets of info included in the article:

"There has been an alarming increase in the number of threats since President Kennedy took office. The Secret Service investigated 870 threatening letters addressed to the President last year [1961]. .... The figures are about 50% higher than those for the last year of the Eisenhower administration."

Those figures mean that President Kennedy was receiving an average of about 2.5 threats by mail each and every day in 1961. And that's just the letters. Who knows how many more verbal threats were being aimed at Kennedy in other ways (via telephone, TV, radio, etc.).

BOB NESS SAID THIS.

DAVID VON PEIN SAID:

But, whether conspiracy believers like it or not, that's precisely where the evidence leads us, Bob---to that "crazy mixed-up kid" named Oswald.

Just follow Oswald's own movements and actions on both Nov. 21 and Nov. 22. If you do that, you can't help but lean toward the "Lone Assassin" conclusion. It's inevitable.

GIL JESUS SAID:

THE WEAK CASE AGAINST OSWALD:
http://groups.google.com/alt.conspiracy.jfk/2Mhp65Waq6wJ

[...]

1. The alleged murder weapon could not be connected to Oswald and only Oswald. The Mannlicher-Carcano rifle, serial # C2766, was manufacured by ten different manufacturing plants in Italy during WWII and they all used the same serial numbers. To say that THIS PARTICULAR Carcano was the EXACT ONE ordered by A.J. Hidell from Klien's Sporting Goods in Chicago in January 1963 is stretching it. Especially when there were 9 more in the world with the exact same serial number.

DAVID VON PEIN SAID:

The above is a ridiculous (and flat-out wrong) statement that continues to be regurgitated year after year by desperate conspiracy theorists.

Why on Earth would anyone think that there were TEN Carcano rifles manufactured with the exact same serial number of C2766 (or any other serial number)? Such a belief is foolish. Plus, it totally defies the whole reason for distinct "serial numbers" being placed on products in the first place, which is to give each individual item its own unique and singular identity. Otherwise, what's the point of putting any serial number on any product?

And, of course, we've never once seen any conspiracy theorist actually provide any proof that there were multiple Mannlicher-Carcano Model 91/38 rifles produced at the various Italian manufacturing plants with the same identical serial number of C2766. That ludicrous belief resides only in the vivid imaginations of many conspiracy believers.

GERRY DOWN SAID THIS.

DAVID VON PEIN SAID:

NBC-TV was the only network that actually managed to air the murder of Lee Harvey Oswald "live". The other television networks only showed replays. CBS missed it by just 5 seconds or so.

The CBS affiliate in Dallas—KRLD-TV—did videotape the shooting "live" as it was happening in the police basement, but whether or not anyone watching KRLD-TV actually saw this live footage of the exact moment of the shooting, I really do not know. It's quite possible that KRLD, like most other CBS affiliate stations at that time, was airing Roger Mudd's report from the steps of the U.S. Capitol at the precise moment when Ruby was killing Oswald. I'm just not sure.

JOE BAUER SAID THIS.

DAVID VON PEIN SAID:

I'm not unsure about who killed JFK at all. Far from it.

And that's because the evidence speaks loudly in this case. And that evidence is pointing directly at one single person and no one else.

But conspiracy theorists are always insisting that I should just disregard the physical evidence in this case because those CTers are always insisting (without a shred of proof, of course) that the evidence is all (or mostly) fake and/or manufactured.

And Lee Harvey Oswald's very own unusual (and incriminating) actions and statements/lies on Nov. 21 and Nov. 22 are also things that conspiracy theorists don't want me to pay too much attention to either.

But I guess it's understandable why the "Oswald Is Innocent" conspiracy promoters want to stay a million miles away from Oswald's very own actions and movements. Because these things that Oswald did and said on 11/21/63 and 11/22/63 are saturated with his very own guilt.

Have you, Joe, ever even considered the possibility that Oswald was guilty and that there was no conspiracy---and that the idea of "conspiracy" in the JFK and J.D. Tippit murder cases has been the product and the invention of the many conspiracy theorists over the years who, let's face it, have been trying their darndest to find any signs of a conspiracy in the JFKA case (but, to date, have proved nothing)?

And doesn't at least the bulk of the evidence in the JFKA case suggest to you at least the possibility that Lee Oswald could have accomplished the murders of John Kennedy and Officer Tippit on his own, without the aid of anyone else's assistance or guiding hand?

I think it's about time for the JFKA conspiracy theorists to consider another reality. Namely, this one:

JOHN CORBETT SAID:

It's amazing how many misconceptions there are about the shots. The reality is the WC [Warren Commission] never concluded which shot missed. They didn't think they had conclusive evidence.

For many years, the popular misconception was that the second shot missed and all three shots were fired in 5.6 seconds. The WC did consider that a possibility, but did not commit to it.

Oliver Stone was particularly duplicitous on this point. In the scene in which Kevin Costner and his aide recreated the shooting, Costner supposedly timed the three shots at over 7 seconds and the aide said Oswald couldn't have fired 3 shots in 5.6 seconds, which would only have been a requirement if the second shot missed. Then the aide falsely claimed the WC concluded the first shot missed, which the WC never did.

What Stone did was conflate two mutually exclusive scenarios and present both as conclusions of the WC.

Given the luxury of decades of observation of the Z-film, we are able to conclude that it is almost certain it was the first shot that missed, but that was not a conclusion of the WCR.

JFK ASSASSINATION ARGUMENTS
(PART 1024)

PAT SPEER SAID:

The people answered [the ABC poll question] based upon the question of whether or not Oswald was involved. You have extrapolated from this that ALL these people thought he was a shooter. Being involved does not equal being a shooter. It follows then that many responded in a manner indicating Oswald was a shooter because they didn't want to say he wasn't involved at all.

DAVID VON PEIN SAID:

To believe Pat Speer here, we have no choice but to believe that a large number of the 1,031 people who responded to the question shown below (which was part of a 2003 ABC News poll) decided to TOTALLY IGNORE the key word "GUNMAN" which appears in the FIRST TWO-THIRDS of the question. Patrick Speer must, indeed, be of the opinion that almost all of the people who responded to this question were complete idiots (because, per Speer, the majority of these people should have really answered "No Opinion" to this question, instead of answering as they did):

"Do you think Lee Harvey Oswald was the only gunman in the
Kennedy assassination, do you think there was another gunman in
addition to Oswald there that day, or do you think Oswald was not
involved in the assassination at all?":

ONLY OSWALD ------------- 32%
ANOTHER GUNMAN -------- 51%
OSWALD NOT INVOLVED --- 7%
NO OPINION --------------- 10%

http://PollingReport.com/The-Kennedy-Assassination

PAT SPEER SAID:

If, on the other hand, you continue to play this game, and continue to insist that the vast majority of those suspecting a conspiracy believe Oswald shot Kennedy as part of a conspiracy...

DAVID VON PEIN SAID:

It's not a "game" at all, Pat. I think that ABC News poll is probably pretty doggone accurate and likely represents the thoughts of the "mainstream" in America fairly well regarding Oswald's involvement AS A GUNMAN in JFK's murder.

It's only the outer-fringe conspiracy believers (like the CTers who regularly post at Internet JFK forums) who represent a "majority" in the "Anybody But Oswald" club. But I'd wager to say that the majority of people in the world who have an opinion on the matter think Oswald took some shots at Kennedy.

PAT SPEER SAID:

...you should at least enlighten us as to who these people think Oswald was working for. Was it the mafia? .... Or was it the CIA? In which case Bugliosi and all other critics of [Oliver] Stone would also owe him an apology, as it would prove those suspecting a conspiracy had completely rejected Stone's proposition Oswald was a patsy, and had formed their own conspiracy theory based upon the films or writings of...no one. So, for which of these reasons does Bugliosi (and you, and every other LN on this forum claiming Stone had misled millions of people into believing a conspiracy in which Oswald was a patsy) owe Stone an apology? We're waiting...

DAVID VON PEIN SAID:

Pat, you're resembling Mister Salty more every day -- i.e., you seem to like to "twist" things all out of shape.

How many hours of pondering did it take you before writing that last hunk of silliness about Bugliosi owing Oliver Stone an "apology" (of all things!)?

Good Lord, you think that Bugliosi owes Stone AN APOLOGY for mangling virtually all of the facts in the JFK case in his 1991 fantasy movie?!

And you think this "apology" is in order because the general public at large (per the ABC poll at least) believes that Oswald really wasn't the innocent patsy (i.e., a non-gunman) as portrayed in Stone's film, even though most of that same general public still believes in a conspiracy of some kind to kill Kennedy?

You must be kidding.

BTW, you think "no one" has ever written a book or magazine article or newspaper story or movie or TV show that has Oswald being a gunman in conjunction with a conspiracy? That's really a strange thing to say, Pat, because not EVERY pro-conspiracy book or article advocates Oswald as a non-gunman or innocent dupe.

A good thing for Pat (or anybody) to do would be to conduct a "poll" of their own, and ask a whole bunch of strangers on the street (or several friends and relatives) the two key questions that I asked in my poll in this forum thread:

1.) DO YOU THINK LEE HARVEY OSWALD FIRED ANY GUNSHOTS AT PRESIDENT KENNEDY ON NOVEMBER 22, 1963?

2.) DO YOU THINK LEE HARVEY OSWALD SHOT AND KILLED DALLAS POLICE OFFICER J.D. TIPPIT ON NOVEMBER 22, 1963?

After getting, let's say, about 40 or 50 firm "Yes" or "No" answers (especially to question #1), what do you think the results would be? Would the results be closer to ABC's 7% in the "OSWALD WAS NOT A GUNMAN" category? Or would the percentage in that category be much higher than ABC's 7% (like it is at every JFK forum on the planet)?

Might be interesting to find out, huh?

PAT SPEER SAID:

Neither you nor [Vincent Bugliosi] believes that poll. Not even for one second. And I wish you'd just admit it.

DAVID VON PEIN SAID:

I have absolutely no good reason to disbelieve or distrust that particular ABC News poll. The question that TWICE has the word "gunman" attached to it is as clear as the nose on Jimmy Durante's face.

But if I WERE to disbelieve that "7%" ABC poll, where does that really lead? I'll tell you where -- such a belief leads to a vast MAJORITY of Americans actually falling into "Kookville". Because under such conditions of totally disbelieving that ABC poll, the vast majority of Americans (just like the majority of CTers at every JFK forum known to man) really DON'T believe Lee Oswald fired even a single shot at President Kennedy.

Do you REALLY want me to come out and say that I believe that MOST Americans are kooks when it comes to their beliefs in the JFK case -- from the limited standpoint, that is, of the question that I asked in my own poll in this thread: "DO YOU THINK LEE HARVEY OSWALD FIRED ANY GUNSHOTS AT PRESIDENT KENNEDY ON NOVEMBER 22, 1963?"?

I guess I COULD come out and say that the majority of Americans (the "mainstream", that is) are just exactly like all of the "Anybody But Oswald" conspiracy theorists on the JFK forums, but the 2003 ABC News poll is making it very difficult for me to believe such a thing.

PAT SPEER SAID:

According to the [ABC News] poll...the arguments of most every conspiracy theorist, including Oliver Stone, have been thoroughly rejected by the public. If the public has already rejected these theories, then, WHY would Bugliosi spend 1500 pages or so trying to prove them wrong? What is he, a geriatric, with nothing better to do with his time than argue a case he has already won?

DAVID VON PEIN SAID:

Huh? Are you high on conspiracy fumes or something, Pat??!

You think that Vince Bugliosi had already "won" the case, even with these conspiracy numbers staring him in the face in 2003 (four years before his JFK book was published)?:

================

GALLUP POLL:

ONE MAN ------------- 19%
OTHERS INVOLVED -- 75%
NO OPINION --------- 6%

================

ABC NEWS POLL:

ONE MAN --------- 22%
BROADER PLOT -- 70%
NO OPINION ----- 8%

================

Pat Speer seems to think that the ONLY thing that Mr. Bugliosi wanted to accomplish in his book "Reclaiming History" was to show that Oswald fired shots at JFK.

Yes, indeed, establishing that Oswald was guilty of shooting President Kennedy was certainly one of Vince's goals when he wrote his book--no doubt about that. But a large part of "Reclaiming History" is called "BOOK TWO: DELUSIONS OF CONSPIRACY: WHAT DID NOT HAPPEN", which takes up a little more than 40% of the book (and CD-ROM of endnotes).

And in "Book Two", Bugliosi is not really talking about Oswald's guilt, because he already establishes LHO's guilt in "Book One". The last words that Vince writes at the end of "Book One" are these words:

"Since we can be absolutely sure that Oswald killed Kennedy, he could not have been a "patsy" (i.e., he could not have been "framed") as many conspiracy theorists love to say. By definition, you can't frame someone who is guilty; you frame INNOCENT people. To frame, per the dictionary, means "to incriminate an innocent person through the use of false evidence." Since we know Oswald was guilty, we thereby know that no other person or persons killed Kennedy and framed Oswald for the murder they committed. Therefore, the only remaining issue worthy of discussion is whether Oswald acted alone, that is, whether he was a part of a conspiracy to murder the president." -- VINCENT BUGLIOSI; PAGE 969 OF "RECLAIMING HISTORY" (c.2007)

----------

So, even if a large number of people (83% via the ABC News poll) do agree with Vince that Oswald was firing shots at JFK in Dealey Plaza, that doesn't mean that Bugliosi's job in "Reclaiming History" was completed. Not by a longshot. Because, as another question in that same ABC poll vividly demonstrates, there's still the 70% of Americans who believe in a conspiracy (whether they believe Oswald was a shooter or not).

BILL BROWN SAID THIS.

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

Not necessarily, Pat.

Oswald was, of course, in a very big hurry right after shooting the President, and as he moved quickly from the Sniper's Nest to the stairway, he simply forgot to wipe off the trigger guard of the rifle (IMO). He was more concerned with the stock of the weapon (IMO).

A dumb mistake on Oswald's part? Yes, it sure was. No doubt about that. But I think he made that mistake nonetheless.

Can I prove any of this? Nope. I sure can't. It's one of those things that can never be "proved"---by anyone. (Unless we have a seance and are successful at making contact with Lee Oswald from his residence down below. Do you happen to know any good spiritual mediums?) 😁

BTW, the scenario that Bill Brown laid out in his forum post linked above (regarding Oswald shooting JFK while only wearing his white T-shirt and then wiping off prints with his brown shirt) is the exact same scenario that I believe is true as well. I talk about it at my "Oswald Timeline" page, originally written in 2007.

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

But that doesn't mean that Lee Oswald would have necessarily been aware of this "rare" fact about the "wooden stock" on 11/22/63, does it Pat?

I think he did wipe down most of the gun with his brown shirt....but he missed the trigger guard prints.

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

Well, Pat, I certainly don't believe for a single solitary second that any of the authorities planted the shirt fibers on the rifle in order to try and frame Oswald. (Which quite obviously is what you believe happened.)

Therefore, I believe there must be a non-"planting" (i.e., non-conspiratorial) answer to what you just said above about the fingerprint powder and the fibers. Just like there is a non-conspiratorial explanation for ALL other "conspiracy" claims made by JFK conspiracy believers (to date). (IMHO.)

Maybe Lieutenant Day did miss seeing the fibers initially. Isn't that a much more likely answer than the CTer "The fibers were planted" explanation?

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

What Pat Speer just said above — "The most likely solution--by far--is that the fibers were planted" — is total bull!

Always remember Hanlon's Razor, Pat....

"Never attribute to malice that which is adequately explained by stupidity."

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

Pat,

The key word in Hanlon's rule of thumb which you seem to have sidestepped in your courtroom scenario above is this important word: "Adequately."

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

But, via Hanlon's adage, the "stupidity" you laid out in your simulated scenario is certainly NOT "adequate". And, just as you said, nobody with an ounce of brains could possibly even begin to believe such nonsense. Therefore, Hanlon's Razor cannot possibly be applied in your given scenario.

But the "Fibers Wedged In The Butt Plate" situation is rather different, and when looking at the WC testimony of the FBI's hair and fiber expert, Paul Stombaugh, I see no problem at all in believing that the fibers became legitimately adhered to Oswald's rifle via ordinary non-conspiratorial, non-planted means.

It seems likely to me that when Lt. Day was dusting the rifle for prints, he merely pushed the fibers into the butt-plate crevice. And that's precisely what Stombaugh says in his testimony (excerpted below):

Mr. STOMBAUGH. I found a tiny tuft of fibers which had caught on that jagged edge, and then when the individual who dusted this dusted them, he just folded them down very neatly into the little crevice there, and they stayed. These I removed and put on a glass microscope slide, and marked this particular slide "No. 2," because this little group of fibers--little tuft of fibers, appeared to be fresh. The fibers on the rest of the gun were either adhering to a greasy, oily deposit or jammed into a crevice and were very dirty and apparently very old.

[...]

Mr. STOMBAUGH. ...This was just a small tuft. They were adhering to the gun on a small jagged edge. In other words, the gun had caught on a piece of fabric and pulled these fibers loose. They were clean, they had good color to them, there was no grease on them and they were not fragmented. They looked as if they had just been picked up. They were folded very neatly down in the crevice.

Mr. EISENBERG. Were these fibers in a position where they could have easily been knocked off by rough use?

Mr. STOMBAUGH. No; they were adhering to the edge rather tightly.

Mr. EISENBERG. In the crevice?

Mr. STOMBAUGH. Well, it had the jagged edge sticking up and the fibers were folded around it and resting in the crevice.

Mr. DULLES. I think you testified, though, that might have been done in part by the dusting?

Mr. STOMBAUGH. Yes, sir; I believe when the fingerprintman dusted it he probably ran his brush along the metal portion here.

Mr. EISENBERG. Of the butt plate?

Mr. STOMBAUGH. Of the butt plate, and at the time the brush folded these down into the crevice.

Mr. EISENBERG. What led you to the particular conclusion that they had been folded into the crevice by the dusting?

Mr. STOMBAUGH. Because of the presence of fingerprint powder being down in and through the crevice here. It looked as if it had been dusted with a brush. You could make out the bristlemarks of the brush itself.

-------------------

Pat,

Where did you get your information about the fibers being ON TOP of the fingerprint powder? I can't find anything in Stombaugh's testimony where he says any such thing. The closest would be this passage here, but he doesn't specifically say the fibers were resting ON TOP of the powder:

"These were fairly good long fibers. They were not dirty, with the exception of a little bit of fingerprint powder on them which I cleaned off, and the color was good."

Is there other testimony from somebody other than Stombaugh about the rifle fibers which says they were "On Top" of the powder?

Also....

Pat, do you also believe that the fibers found in the CE142 paper bag (which generally matched the blanket in Ruth Paine's garage) were "planted" by the cops too? Just wondering.

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

Your last comments about the rifle fibers didn't "prove" your point that those fibers were planted at all, Pat. Not even close.

You're being too overzealous in your efforts to paint the DPD as rotten evidence-planters here, Pat. You're telling us what you THINK Stombaugh SHOULD have said in a given scenario. But I don't think you're correct in your assumptions about Stombaugh's testimony at all.

Because there's no reason to believe that Lt. Day's dusting of the rifle couldn't have resulted in some of the fingerprint powder working its way down into the crevice of the gun. And this section of Stombaugh's testimony says that the fibers were "caught" on a "jagged edge" of the gun, and then Lt. Day pushed ("folded") them further down into the crevice:

"I found a tiny tuft of fibers which had caught on that jagged edge, and then when the individual who dusted this dusted them, he just folded them down very neatly into the little crevice there, and they stayed."

Nothing sinister or even unusual there at all, IMO. And there's most certainly nothing in Stombaugh's testimony that would lead me to think the fibers were definitely resting ON TOP of all of the fingerprint powder. He just simply did not make any such definitive statement.

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

You're totally misrepresenting what Stombaugh said. He said (my emphasis):

"I found a tiny tuft of fibers which had caught on that jagged edge, and then when the individual who dusted this dusted them, he just folded them down very neatly into the little crevice there, and they stayed."

It's the "jagged edge" that tore the fibers from Oswald's shirt. They were adhering to that "jagged edge" and then when Lt. Day came along with his brush, he "folded" them down into the crevice.

That's a very logical conclusion, and it doesn't require any conspiracy or cover-up involving anyone.

And there's no reason at all why a scenario couldn't have occurred which had Lt. Day dusting the crevice area of the rifle FIRST (before he ever touched the fibers), thus filling the crevice with powder, and only THEN he folded the fibers down into that crevice which was now filled with fingerprint powder. You can't possibly prove some scenario like that didn't occur.

In my opinion, Pat, the manner in which you have evaluated Paul Stombaugh's testimony and the whole "Fibers On The Rifle" topic is the only thing here that "smells to high heaven".

Plus....

It looks like most CTers here have decided to just take the word of the accused assassin when he claimed that he changed his shirt at his roominghouse on Nov. 22 (from a red one to a brown one)---even though we know from the testimony of at least three witnesses (and there's probably even more) that Oswald WAS wearing a BROWN shirt on 11/22 before he ever went to his roominghouse that day. (See my next post for more about this.)

GREG DOUDNA SAID THIS.

DAVID VON PEIN SAID:

But there are statements from multiple witnesses who saw Oswald on Nov. 22 BEFORE he ever went home to his Beckley room, with those witnesses saying that they saw Oswald wearing a BROWN shirt. Marrion Baker being one such witness (and I think it's reasonable to think that when Baker said "brown jacket", he was talking about LHO's brown untucked shirt, because we know that Oswald didn't even own a brown "jacket").

Another "brown shirt" witness is Mary Bledsoe, who saw Oswald on Cecil McWatters' bus, which was also before Oswald ever had any chance to get to his roominghouse to change any clothes on 11/22:

Mr. BALL -- Now, what color shirt did he have on?
Mrs. BLEDSOE -- He had a brown shirt.

And another "brown shirt" witness is cab driver William Whaley:

Mr. WHALEY -- He had on a brown shirt with a little silverlike stripe on it.

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

And your thinking that no powder at all could have gotten into the crevice is mind-bogglingly silly on your part. (After all, those DPD cops were nothing but incompetent boobs most of the time, right?)

Anyway, obviously SOME powder DID seep into the crevice, whether it was intentionally done by Day or not.

Once again, like most CTers in the world, you're putting some kind of conspiratorial/sinister spin on something that doesn't require it at all. You should stop doing that, Pat.

Nothing about this "Fibers In The Butt Plate" issue seems the slightest bit suspicious or strange or "cover-uppish" to me. It's the CTers who are creating the "strangeness" and the "suspicion" (IMO).

DAVID VON PEIN ALSO SAID:

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

But if there had REALLY been any curtain rods (i.e., if Oswald really had rods in his large package on 11/22), then Oswald would (of course) have told the police that fact after he was in custody. That only stands to reason. But he didn't do that. Instead, he denied all knowledge of any curtain rods.*

* Yes, I know CTers will insist that I'm supposed to believe that Captain Fritz was the "real liar" in this regard....but IMO that solution is just not a reasonable one. Certainly not as reasonable or realistic as having the accused assassin being the one telling the police tall tales. Plus, it's not ONLY Fritz we'd have to call a liar here. It's other people too--like Jim Bookhout of the FBI and Thomas Kelley of the Secret Service:

"He [LHO] denied telling Wesley Frazier that the purpose of his visit to Irving, Texas, on the night of November 21, 1963, was to obtain some curtain rods from Mrs. Ruth Paine." -- James W. Bookhout; 11/23/63 FBI Report

And this is a conspiracy fantasist who thinks there were two Lee Oswalds and two Marguerite Oswalds and who also has the temerity to gush forth this ridiculous and absurd statement:

DAVID JOSEPHS SAID THIS.

DAVID VON PEIN SAID:

Quoting the late Vincent Bugliosi (who knew more than just a little bit about the subject of "Admissible Evidence" at a court trial):

"An argument frequently heard in the conspiracy community is that Oswald could not have been convicted in a court of law because the "chain of custody [or possession]" of the evidence against him was not strong enough to make the evidence admissible in a court of law. .... The first observation I have to make is that I would think conspiracists...would primarily want to know if Oswald killed Kennedy, not whether he could get off on a legal technicality.

Second, there is no problem with the chain of custody of much of the physical evidence against Oswald, such as the rifle and the two large bullet fragments found in the presidential limousine.

Third, and most important on this issue, courts do not have a practice of allowing into evidence only that for which there is an ironclad and 100 percent clear chain of custody, and this is why I believe that 95 percent of the physical evidence in this case would be admissible.

I can tell you from personal experience that excluding evidence at a trial because the chain of custody is weak is rare, certainly the exception rather than the rule. The typical situation where the chain is not particularly strong is for the trial judge to nevertheless admit the evidence, ruling that the weakness of the chain goes only to "the weight of the evidence [i.e., how much weight or credence the jury will give it], not its admissibility"."

DAVID VON PEIN SAID:

And here are two more quotes from Mr. Bugliosi that should be very easy for any reasonable person to wholeheartedly agree with who has been exposed to the threadbare arguments presented by the various conspiracy theorists since 1963:

-------------------

"The dreadful illogic and superficiality of the conspiracy theorists' modus operandi has inevitably resulted in the following situation: Though they have dedicated their existence to trying to poke holes in the Warren Commission's findings, they have failed abysmally to tell us (if the Warren Commission was wrong) what actually did happen. In other words, other than blithely tossing out names, they have failed to offer any credible evidence of who, if not Oswald, killed Kennedy. Nor have they offered any credible evidence at all of who the conspirators behind the assassination were. So after more than forty years, if we were to rely on these silly people, we'd have an assassination without an assassin (since, they assure us, Oswald didn't kill Kennedy), and a conspiracy without conspirators. Not a simple achievement." -- Vincent Bugliosi; Page 982 of "Reclaiming History"

-------------------

"The conspiracy community regularly seizes on one slip of the tongue, misunderstanding, or slight discrepancy to defeat twenty pieces of solid evidence; accepts one witness of theirs, even if he or she is a provable nut, as being far more credible than ten normal witnesses on the other side; treats rumors, even questions, as the equivalent of proof; leaps from the most minuscule of discoveries to the grandest of conclusions; and insists that the failure to explain everything perfectly negates all that is explained." -- Vincent Bugliosi; Page xliii of "Reclaiming History"

One more VB gem---just for the common sense (and the laughs):

"The Garrison devotees have apparently never been troubled by the question of why [Clay] Shaw and [David] Ferrie would select Oswald, of all people, as their hit man...or patsy when they had no way of knowing that the president would even come back to New Orleans, where Oswald lived at the time. Or were they planning to finance Oswald as he traveled, Carcano in his violin case, all around the country stalking Kennedy for a good opportunity to kill him or be the patsy for someone else who would? If the latter, aren't they troubled by the fact that we know, from Oswald's known whereabouts, that he never did travel around the country?" -- V. Bugliosi; Page 847 of "Reclaiming History" Endnotes

LANCE PAYETTE SAID THIS.

RON BULMAN SAID THIS.

DAVID VON PEIN SAID:

Oswald, himself, admitted to having the gun in the theater (see Warren Report, Pg. 601).

Plus, in order to promote the "Oswald Didn't Really Have Any Gun In The Theater" theory, you'd have to call civilian witness Johnny Brewer a liar too. And is that a reasonable thing to do?

Plus:

If Lee Oswald had really been innocent of killing BOTH John Kennedy and J.D. Tippit, as so many CTers seem to believe he was, then why did Oswald act like such a GUILTY person in the Texas Theater?

Do completely innocent people normally do the things we know Oswald did while he was being apprehended in the theater that day? Things such as pulling a gun on police officers and saying things like "It's all over now" and/or "This is it". Those two verbal statements—all by themselves—are extremely incriminating circumstantial evidence against Lee Oswald.

What do CTers think Oswald meant by "It's all over now" or "This is it"? (And he most certainly uttered at least one of those phrases, if not both, on Nov. 22 in the theater.) Can any conspiracy theorist explain (in a reasonable and believable way) what the "IT" means in each of those statements?

More on Oswald's post-arrest behavior here.

RON EGE SAID THIS.

DAVID VON PEIN SAID:

IMO, Oswald's "Assassination Plan" (if we can call it that) has all the earmarks of being a virtually last-minute plan with no advanced thought at all of any escape plan. I think that's obvious by just examining the things he did on both Nov. 21 and 22.

I also think that Oswald himself truly felt (on Friday morning) that he very likely would have no real opportunity to pull off a successful assassination from anyplace within the Book Depository.

So many things could have interrupted his plan to shoot from any of the windows within the TSBD. But luck was certainly with him that day, no doubt about it, when Bonnie Ray Williams elected to vacate the sixth floor just in time for Oswald to accomplish his task on an empty 6th floor.

If only Bonnie Ray had decided to finish his chicken-on-the-bone sandwich on Floor #6. If he had done so, would tragedy have been averted? I think so. (Apart from Bonnie Ray's tragic dental bill, that is.)

DAVID VON PEIN ALSO ADDED:

A few other thoughts [via a 2015 discussion]....

"Lee Oswald might just have been winging it. (Who knows.) His assassination plan, as we know, was practically done at the last minute. I think he was probably extremely surprised that he was actually able to have that 6th floor of the TSBD all to himself long enough to get the job done and fire those three shots at JFK --- because given all the obstacles and potential witnesses that could have caused him to abort his assassination efforts, I just don't see how Oswald's state of mind on the morning of November 22nd could have been anything other than this one ----

"Since I'm not on a suicide mission today, and since so many things could happen that could cause me to change my mind about pulling the trigger on the President (including the weather and the actions of other people in the building), I'm not too confident of being able to pull this assassination off. If I'm able to do it, fine. But if not, that's fine too."

Now, given such a mindset leading up to 12:30 PM on 11/22/63, it's quite possible that Lee hadn't put any thought at all (or very little thought) into what he would do afterward. Therefore, after he did the dirty deed and was able to escape the building, his mindset could very well have been --- "Gee, what the f**k do I do now?!" "

CORY SANTOS SAID THIS.

DAVID VON PEIN SAID:

I would guess that when given a choice of which political figure to take a shot at (Kennedy or Nixon) during those days in late November of 1963, Lee Oswald had his "sights" set a little higher than Mr. Nixon (plus there's also the important additional fact that one of those political figures was going to be driving slowly past the front door of Oswald's very own workplace). So I don't imagine the choice was too difficult.

Or are you suggesting that Oswald could have killed two birds with one Carcano in Dallas in Nov. '63? I suppose he could have bagged Nixon at his Pepsi convention on November 21st and then while Lee was at work on Nov. 22, he could get himself a second politician in JFK.

And he could have gone for the Hat Trick by also taking out Lyndon Johnson while his car was also on Elm Street on 11/22. 😁

BTW, speaking of Oswald wanting to take a shot at Nixon, I've added this page to my website ---> Oswald And The Nixon Incident.

FRED LITWIN SAID:

The CIA Wants You to Read My Book! ["Oliver Stone's Film-Flam"]

A one-star review on Amazon reveals I am being paid by the CIA. The accusation that I am some sort of shill for the CIA surfaces every week.

DAVID VON PEIN SAID:

Like Fred, I too have grown accustomed to being called a "CIA asset" by the conspiracists. In this review for my 2014 JFK book, here's somebody who thinks I'm "friends" with the CIA:

"I guess that the friends of the CIA and the perpetrators of a coup d'état have nothing better to do after fifty years than to lie, lie, and tell more lies."

And here's another mental giant who seems to want to tie me (and Mel Ayton) in to the Langley agency:

"Is this author...on the payroll of the CIA or some other perpetrator of the crime of the century?"

Overall, though, the Amazon reviews and ratings for my book have been pretty decent (averaging 4.2 out of 5 [as of 2/11/2023]). The "DVP is CIA" mob is lagging behind! 😁

VINCE PALAMARA SAID THIS.

DAVID VON PEIN SAID:

After taking a quick glance at Matt Douthit's review/hit piece of Fred Litwin's latest book, here are just three things (among many) that Douthit gets wrong:

1.) Fred Litwin never implied that O.P. Wright gave CE399 to Secret Service Agent Richard Johnsen at 7:30 PM. That's absurd. The 7:30 time comes from Johnsen's memo that he wrote after he returned to the White House on 11/22. Johnsen wrote that memo at 7:30. That's the "7:30" that Fred Litwin is referring to in his book. And Bob Frazier would have no doubt seen Johnsen's "7:30 note", which was still stapled to the envelope containing CE399 when Todd delivered the bullet to Frazier.

2.) And Fred is certainly correct when he says that John Connally's account of the shooting generally supports the SBT. And that's mainly because all reasonable people know that John Connally is just about the WORST EYEwitness in Dealey Plaza when it comes to the question of: Did the first shot hit JFK? John B. Connally could not possibly have answered that question knowledgeably....because he never saw JFK during the operative timeframe. Why CTers ignore that basic fact is beyond me.

3.) Then, of course, there's the ridiculous assertion made by Douthit (and other CTers, such as DiEugenio) that Fred Litwin's book ("Oliver Stone's Film-Flam") isn't really a book at all---simply because much (or most) of the contents of the book started out in blog form on Fred's website. But....so what? I'm sure that many books have been published that started out in different non-book forms. But once they're compiled and completed and edited (with sources added), etc., they become books. (Duh.) This repeated "It's not really a book" refrain is nothing but an additional excuse used by conspiracy theorists to trash and disregard the well-sourced contents of Fred's book. In short, it's a pathetic (and totally absurd) complaint.

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

You're dead wrong here, Pat. As I said, John Connally was THE WORST eyewitness in Dealey Plaza. He himself (sans his wife) cannot say which shot hit Kennedy. No way. No how. And he's always said he was not hit himself by Shot 1 and he was hit by Shot 2. Perfectly consistent with the SBT.

In my opinion, 99% of John Connally's anti-SBT stance over the years came from his wife and his unwillingness to go against Nellie's account. And, of course, we know via the Zapruder Film that Nellie herself was certainly not turned in such a way at the proper time to see whether JFK was hit by Shot #1 or not. So she's not really a very good EYEwitness either (with respect to the validity of the SBT).

PAT SPEER SAID THIS.

GERRY DOWN SAID THIS.

DAVID VON PEIN SAID:

I still wonder why CTers refuse to admit this fact:

John Connally HIMSELF could not possibly have KNOWN FOR CERTAIN whether he was hit by the same bullet that struck President Kennedy due to the fact that Governor Connally DID NOT SEE JFK at the point in time when Kennedy was first struck.

Therefore, based on his own personal observations, how can John Connally KNOW that the Single-Bullet Theory is untrue. He can't. He couldn't. And he didn't.

I don't yet recall speaking to a single conspiracy advocate who will admit to the fact I just outlined in the above paragraph. Why is that?

~strokes chin in bewilderment~

Another Fact:

Governor John B. Connally's anti-SBT stance was derived almost totally from his wife Nellie's adamant anti-SBT opinions. And I don't see how anyone can possibly argue otherwise.

ANDREW PRUTSOK SAID THIS.

DAVID VON PEIN SAID:

I disagree (in this instance). Because the three things in my last post that I put in ALL CAPS are absolute FACTS that (for some mysterious reason) almost all CTers just glide right past and ignore entirely.....as if John Connally HAD actually SEEN the President at the proper "SBT" timeframe and did KNOW FOR CERTAIN that the SBT was pure bunk. But neither of those things are true, and never were true.

So why do CTers continue to use John Connally as the perfect anti-SBT witness when he's really just the opposite?

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

John Connally's never-wavering statements regarding the sequence of the shots and which shot hit him are fully supportive of the SBT. Those are the statements I was talking about. Not his misguided belief that the SBT is wrong. (Which is a belief we all know he inherited from his wife, because it's certainly not based on anything Mr. Connally himself saw or heard.)

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

John Connally was highly influenced by his wife's opinion. You surely don't deny that, do you?

You, Pat, put a lot of stock in Governor Connally's "impressions". But, IMO, such "impressions" aren't worth very much when we realize (as we must) that Mr. Connally's "impressions" were derived without even seeing the President at any time during the critical time period in question.

Also:

Please post something to verify this statement of yours, Pat:

"At times he [John Connally] even said he'd heard the impact on Kennedy." -- Pat Speer; 2/14/2023

Because I never once heard Governor Connally say (or even vaguely imply) any such thing when talking about the first shot that was fired.

Mr. Connally always said he heard the impact of Kennedy getting hit with the head shot, yes. But shot #1? I don't think so.

I think you're mixing up your "heard the impact" shots, Pat.

PAT SPEER SAID THIS.

DAVID VON PEIN SAID:

Thank you for forthrightly clearing that up, Pat. I appreciate it.

But, despite what Governor Connally "sensed" (but didn't SEE, remember), the Single-Bullet Theory is most certainly not the "hoax" that Pat Speer believes it to be.

The following statement is one I make with all sincerity...

When ALL the evidence is considered (including the large number of "SBT"-like things that exist surrounding the wounding of President Kennedy and Governor Connally), it would truly be a miracle if the SBT were NOT true.

JOE BAUER SAID THIS.

DAVID VON PEIN SAID:

Henry Wade's news conferences on the weekend of the assassination:

http://dvp-potpourri/henry-wade-press-conference-11-22-63

http://dvp-potpourri/henry-wade-press-conference-11-24-63

The name "Fair Play For Cuba Committee" was mentioned on NBC-TV at about 4:00 PM (Dallas time) on 11/22 [audio and video linked here]. And the FPCC was undoubtedly also mentioned on other TV and radio outlets as well (because if NBC had it, you know other networks had it too).

So Jack Ruby (and everybody else in America) could have easily known about Oswald's affiliation with the FPCC many hours before Henry Wade's late-night press conference on Friday night.

RON BULMAN SAID THIS.

DAVID VON PEIN SAID:

Any number of media people who had contact with Lee Oswald in New Orleans in the summer of '63 could (and probably did) provide all the information they had on Oswald immediately after the assassination (seeing as how Mr. Oswald was the most talked-about person on the planet during the hours just after JFK was murdered).

And that info coming from New Orleans would have included information about the "Fair Play For Cuba Committee", which was info that was originally provided (voluntarily) by Lee Oswald himself in August of '63 via his radio and television interviews on New Orleans stations WDSU-TV and WDSU-Radio.

I would guess that right after the name "Lee Harvey Oswald" was first revealed as the prime suspect in the assassination, the people at WDSU in New Orleans were on the phone as quickly as they could dial, providing national media outlets with all the information they had on Oswald (including their video and audio tapes of Oswald's interviews).

There was nothing sinister about such "FPCC" information being shared with the national news media very quickly. Given the fact that every newsman in the country was no doubt hungry for ANY info pertaining to this guy named Oswald in the hours after JFK was shot, I don't find it surprising in the least that the national television networks found out that Lee Oswald was affiliated with the FPCC by 4:00 PM CST on Nov. 22. In fact, I would have expected that information to come out very quickly. Because that's what good newsmen and reporters do---they dig stuff up. And many times they dig it up very quickly.

IAN LLOYD SAID THIS.

DAVID VON PEIN SAID:

Well, it looks like yet another conspiracy myth has sprouted up out of the woodwork, with this newest myth revolving around the subject of "outside contract workers laying the new plywood floor on the 5th & 6th floors".

But, however, we know from the Warren Commission testimony of various witnesses that the floor-repairing project that was going on in the Book Depository Building on 11/22/63 was most definitely not being done by "outside contract workers" at all. It was, instead, being done by the regular TSBD employees. And that fact is confirmed in the testimony of multiple Depository workers, including Bonnie Ray Williams [at 3 H 163], Billy Lovelady [6 H 337], Danny Arce [6 H 364], and Superintendent Roy Truly [3 H 237].

Here's an excerpt from page 26 of Vincent Bugliosi's book, "Reclaiming History", concerning the topic of the floor-laying crew (click to enlarge):

BENJAMIN COLE SAID THIS.

DAVID VON PEIN SAID:

Nonsense. There's no problem whatsoever with the validity of the bullet shells found at the scene of J.D. Tippit's murder. The only "problem" lies with the conspiracy theorists and their constant inability to fairly and properly evaluate the evidence in the JFK and Tippit cases.

All four of the Tippit bullet shells were conclusively tied to the .38 Smith & Wesson revolver that Lee Harvey Oswald had in his possession when he was arrested inside the Texas Theater—which is an arrest that occurred a mere 35 minutes after Officer Tippit was shot. Which, of course, can only lead to one logical conclusion——Oswald killed Tippit. (With the only other alternative being this very absurd one.)

A key fact concerning the murder of J.D. Tippit that most conspiracy theorists continue to deny to this day is this fact:

The two shell casings found by the two Davis girls have a rock-solid and clear chain of custody after those shells made it into the hands of the Dallas Police Department, with Captain George M. Doughty and Detective C.N. Dhority of the DPD both placing their marks on the one shell (each) that they handled on 11/22/63.

Dale Myers saw and photographed those shells at the National Archives many years ago, with Myers taking note of the markings that exist on the inside lip of each shell. (See pages 267 and 268 of Myers' book "With Malice" [1998 Edition].)

And Myers also points out in his book the fact that each of those police officers (Doughty and Dhority) positively identified those bullet shells (one each) in 1964 (via Warren Commission Exhibit No. 2011, on Page 7 and Page 8).

So, even if we were to throw out the two "Poe" bullet shell casings (due to the confusion of whether or not Officer J.M. Poe marked those two shells), it wouldn't make a bit of difference....and everybody (even all CTers) should know why it doesn't make a bit of difference. It's because we know from the witness testimony that there was only ONE gunman at the Tippit murder scene. And, quite obviously, that ONE gunman was only dumping shells on the ground from ONE single gun at Tenth & Patton on 11/22/63.

Therefore, ALL FOUR shells that were found at 10th and Patton (including the two Poe shells) were obviously dropped there by the ONE AND ONLY gunman who shot Officer Tippit. (Why does logic and common sense like this never seem to enter the heads of JFK conspiracists?)

And with respect to Gerald Hill's 11/22/63 radio transmission about the Tippit shells being from an "automatic" weapon, let's hear what Sergeant Hill had to say about that subject in this 1993 interview (fast-forward to 15:05).

DAVID VON PEIN SAID:

The fact is: ALL Depository witness "timelines" of when they saw Oswald are GUESSES and "approximations". A 12:15 witness might very well be off by several minutes in their estimate. Nobody was looking at a clock when they said they saw LHO at a certain time.

And it's silly for CTers to place so much weight on Carolyn Arnold's "12:15" timing or Eddie Piper's "Just at 12:00" testimony, with those CTers all the while ignoring all the evidence pointing to LHO as the assassin.

Plus: there's Oswald's HUGE "curtain rods" lie that he twice dished up for Buell Frazier. That one single provable lie, virtually by itself, proves Lee Oswald's guilt. (At least for reasonable people.)
